G. INWERKINGTREDING

De bepalingen van de Overeenkomst zijn ingevolge artikel 4, eerste lid, op 3 augustus 1979 in werking getreden voor de Duitse Democratische Republiek, de Bondsrepubliek Duitsland (mede voor West-Berlijn), Frankrijk, Hongarije, Joegoslavië, Luxemburg, de Oekraïne, de Sovjet-Unie, Tsjechoslowakije en Wit-Rusland.

Voor elke Staat die de Overeenkomst na 3 augustus 1978 bekrachtigt of ertoe toetreedt, treedt de Overeenkomst ingevolge artikel 4, tweede lid, in werking twaalf maanden na de datum van nederlegging van de daartoe strekkende akte.

Het Koninkrijk der Nederlanden is niet partij bij de Overeenkomst.

Verwijzingen

Op 1 maart 1973 is te Genève tot stand gekomen een Protocol ter aanvulling van de onderhavige Overeenkomst. De Engelse en de Franse tekst, alsmede de Nederlandse vertaling van dat Protocol zijn geplaatst in Trb. 1975, 114; zie ook Trb. 1997, 29.

Wijzigingen

De Belgische Regering heeft in overeenstemming met artikel 6, eerste lid, wijzigingen van de Overeenkomst voorgesteld, welke de Secretaris-Generaal van de Verenigde Naties in overeenstemming met hetzelfde artikellid, op 27 mei 1994 ter kennis heeft gebracht van alle Verdragsluitende Partijen. De wijzigingen zijn ingevolge artikel 6, tweede lid, letter a, op 27 november 1995 voor alle Verdragsluitende Partijen in werking getreden, behalve voor Duitsland¹ voor welke alleen die wijzigingen in werking zijn getreden die deze Partij niet heeft verworpen.

De Engelse tekst² van de wijzigingen luidt als volgt:

A. PROPOSED AMENDMENTS TO THE ANNEX TO THE 1971 EUROPEAN AGREEMENT SUPPLEMENTING THE 1968 CONVENTION ON ROAD SIGNS AND SIGNALS (E/ECE/812 – E/ECE/TRANS/566)

3.³ Ad Article 1 of the Convention (Definitions)

Insert the following text after the text relating to subparagraph (b):

“Additional subparagraph to be inserted immediately after subparagraph (b) of this Article

This subparagraph shall be read as follows:

“Residential area" means a specially-designed area where special traffic rules apply and which is signposted as such at its entries and exits."

9. Ad Article 10 of the Convention (Priority signs)

Amend the first subparagraph of the text relating to paragraph 6 to read:

“Paragraph 6

To give advance warning of sign B, 1, the same sign supplemented by additional panel H, 1 described in Annex 1, section H to the Convention shall be used." (the remaining text without change)

Insert a new paragraph to read:

“9 bis. Ad Article 13 bis of the Convention (Special regulation signs)

Paragraph 2

This paragraph shall be read as follows: “Signs E, 7a, E, 7b or E, 7c and E, 8a; E, 8b or E, 8c shall notify road-users that the general regulations governing traffic in built-up areas in the territory of the State apply from signs E, 7a; E, 7b or E, 7c to signs E, 8a; E, 8b or E, 8c except in so far as different regulations may be notified by other signs on certain sections of road in the built-up area. They shall bear inscriptions in a dark colour on a white or light-coloured ground and shall be placed respectively at the entries and exits of a built-up area. However, sign B, 4 shall always be placed on a priority road marked with sign B, 3 if that road ceases to have priority where it passes through the built-up area.""

For the existing text of paragraph 10 substitute:

“10. Ad Article 18 of the Convention (Place identification signs)

Place identification signs shall bear inscriptions in white or light colour on a dark-coloured ground."

11. Ad Article 23 of the Convention (Signs for vehicular traffic)

Delete the texts entitled:

“Additional paragraph to be inserted immediately after paragraph 3 of this Article";

“Paragraph 9"

“Paragraph 10,"

“Additional paragraph to be inserted immediately after paragraph 10 of this Article"

For the existing text of paragraphs 17 to 33 of the Annex to the European Agreement substitute:

“17. Ad Annex 1, section A, subsection II, to the Convention

Paragraph 2 (Dangerous descent)

This paragraph shall be read as follows:

“(a) To give warning of a steep descent, symbol A, 2a shall be used.

• (b) The left-hand part of symbol A, 2a shall occupy the left-hand corner of the sign panel and its base shall extend over the whole width of the panel; the figure shows the gradient as a percentage."

Paragraph 3 (Steep ascent)

This paragraph shall be read as follows:

“(a) To give warning of a steep ascent, symbol A, 3a shall be used.

• (b) The right-hand part of symbol A, 3a shall occupy the right-hand corner of the sign panel and its base shall extend over the whole width of the panel; the figure shows the gradient as a percentage."

Paragraph 12 (Pedestrian crossing)

This paragraph shall be read as follows:

“(a) Warning of a pedestrian crossing shall be given by symbol A, 12a.

• (b) The symbol may be reversed."

Paragraph 18 (Intersection where the priority is prescribed by the general priority rule)

This paragraph shall be read as follows: “Warning of an intersection where the priority is that prescribed by the general priority rule in force in the country shall be given by symbol A, 18a."

Paragraph 20 (Intersection with a road to whose users drivers must give way)

This paragraph shall be read as follows: “Sign B, 1 or sign B, 2a shall be used in conformity with the provisions of item 9 of this annex."

Paragraph 22 (Intersection where traffic is regulated by a light signal)

This paragraph shall be read as follows: “If traffic at the intersection is regulated by a light signal, a sign Aa, bearing the symbol A, 17 described in paragraph 17 above, may be set up to supplement or replace the signs described in paragraphs 18 to 21 above."

Paragraph 26 (other level crossings)

Subparagraph (b)

This subparagraph shall be read as follows: “Warning of other level-crossings shall be given by symbol A, 26a or by symbol A, 27 as appropriate.

Paragraph 28 (Signs to be placed in the immediate vicinity of level-crossings)

Model A, 28c of sign A, 28 shall not be used.

Models A, 28a and A, 28b may show red stripes on condition that neither the general appearance nor the effectiveness of the signs is impaired thereby.

18. Ad Annex 1, section B, to the Convention

Paragraph 1 (“GIVE WAY" sign)

Sign B, 1 shall bear neither symbol nor inscription.

Paragraph 2 (“STOP" sign)

This paragraph shall be read as follows: “The “STOP" sign shall be sign B, 2, model B, 2a. Sign B, 2, model B, 2a shall be octagonal with a red ground, surrounded by a narrow white or light yellow border and bear the symbol “STOP" in white or light yellow; the height of the symbol shall be not less than one-third of the height of the panel. The height of the normal-sized sign B, 2a shall be approximately 0.90 m; the height of the small sign shall be not less then 0.60 m."

19. Ad Annex 1, section C, subsection II, to the Convention

Paragraph 1 (Prohibition and restriction of entry)

Model C, 1b of sign C, 1 shall not be used.

The two signs C, 3m and C, 3n reproduced in the appendix to this annex and having the following meaning may be used:

C, 3m “NO ENTRY FOR VEHICLES CARRYING MORE THAN A CERTAIN QUANTITY OF EXPLOSIVES OR READILY INFLAMMABLE SUBSTANCES"

C, 3n “NO ENTRY FOR VEHICLES CARRYING MORE THAN A CERTAIN QUANTITY OF SUBSTANCES LIABLE TO CAUSE WATER POLLUTION".

The note at the end of subparagraph (c) shall be read as follows: “Signs C, 3a to C, 3l as well as signs C, 3m and C, 3n mentioned under this item shall not incorporate an oblique red bar."

Paragraph 4 (Prohibition of overtaking)

Models C, 13ab and C, 13bb of the signs C, 13a and C, 13b shall not be used.

Paragraph 9, subparagraph (a) (ii)

This provision shall not be applied.

Paragraph 9, subparagraph (b) (iii)

This provision shall not be applied.

Paragraph 9, subparagraph (c) (v)

The possibility, where the prohibition applies only over a short distance, of setting up only one sign showing in a red circle the distance on which the prohibition applies, shall not be used.

20. Ad Annex 1, section D, subsection I, to the Convention

Paragraph 2

This paragraph shall be read as follows: “Unless provided otherwise, the signs shall be blue and the symbols shall be white or of a light colour."

21. Ad Annex 1, section D, subsection II, to the Convention

Paragraph 1 (Direction to be followed)

Sign D, 1b shall not be used.

Paragraph 3 (Compulsory roundabout)

This paragraph shall be read as follows: “Sign D, 3 “COMPULSORY ROUNDABOUT" shall have no meaning other than to show the prescribed direction of movement of gyratory vehicular traffic."

22. Ad Annex 1, section E, subsection II, to the Convention

Paragraph 3 (“ONE-WAY" sign), subparagraph (a) (ii)

The arrow of sign E, 3b shall bear an inscription only if the effectiveness of the sign is not impaired thereby.

Paragraph 5 (Signs notitying an entry to or an exit from a motorway)

Additional subparagraph, to be inserted immediately after subparagraph (a) of this paragraph

This subparagraph shall be read as follows: “Sign E, 5a may be used, and repeated, to give warning of the approach of a motorway. Each sign set up for this purpose shall carry either an inscription in its lower part showing the distance between the sign and the beginning of the motorway or an additional panel H, 1 described in Annex 1, section H to the Convention."

Paragraph 6 (Signs notifying an entry to or an exit from a road on which the traffic rules are the same as on a motorway)

Additional subparagraph to be inserted immediately after subparagraph (a) of this paragraph

This subparagraph shall be read as follows: “Sign E, 6a may be used and repeated to give warning of the approach to a road on which the traffic rules are the same as on a motorway. Each sign set up for this purpose shall carry either an inscription in its lower part showing the distance between the sign and the beginning of the road on which the traffic rules are the same as on a motorway or an additional panel H, 1 described in Annex 1, section H to the Convention."

Paragraph 7 (Signs indicating the beginning and the end of a built-up area)

This paragraph shall be read as follows:

“(a) The sign to indicate the beginning of a built-up area shall bear the name of the built-up area or the symbol showing the silhouette of a built-up area of the two combined.

The inscriptions shall be in a dark colour on a white or light-coloured ground and the sign shall have a dark-coloured border.

Signs E, 7a, E, 7b and E, 7c are examples of signs showing the beginning of a built-up area.

• (b) The sign showing the end of a built-up area shall be identical expect that it shall be crossed by an oblique bar coloured red or consisting of parallel lines coloured red running from the upper right edge to the lower left edge.

Signs E, 8a, E, 8b and E, 8c are examples of signs indicating the end of a built-up area.

Notwithstanding the provisions of Article 6, paragraph 1 of this Convention these signs may be placed on the reverse side of signs identifying a built-up area.

• (c) The signs covered by this section shall be used in conformity with the provisions of the Convention, Article 13 bis, paragraph 2."

Paragraph 10 (Pedestrian crossing)

Sign E, 12b shall not be used.

Paragraph 12 (“PARKING" sign)

The square panel mentioned in the first subparagraph of this paragraph shall bear the letter “P".

Add at the end of the text:

“Additional paragraph to be inserted immediately after paragraph 13

This paragraph shall be read as follows:

“Signs notifying an entry to or an exit from a residential area where special traffic rules apply

Sign E, 17a “RESIDENTIAL AREA" shall be placed at the point where the special rules to be observed in a residential area referred to in Article 27bis of the Convention on Road Traffic supplemented by the European Agreement begin to apply. Sign E, 17b “END OF RESIDENTIAL AREA" shall be placed at the point where those rules cease to apply" ".

23. Ad Annex 1, section F, subsection II to the Convention

Paragraph 1 (“FIRST-AID STATION" symbol)

Symbols F, 1b and F, 1c shall not be used.

Paragraph 2 (Miscellaneous symbols)

Add at the end of the text:

“Additional symbols to be inserted at the end of this paragraph

F, 14 “RADIO STATIONS GIVING TRAFFIC INFORMATION"

Inscription on white square: Under the word “radio" there might be an indication of the name or the code of the radio station when necessary in abridged form and the number of the programme. The word “Radio" may be repeated also in the national language.

Inscription on blue ground: Indication of the frequency and, if necessary, the wavelength of the local radio station.

It is left to the discretion of the countries to add in the case of VHF stations the indication “MHz" or the regional code, and in the case of medium-frequency or long-frequency stations the indication “kc/s".

The wavelength may be given in figures with the letter m (e.g. 1500m).

F, 15 “PUBLIC LAVATORY"

F, 16 “BEACH OR SWIMMING POOL"

24. Ad Annex 1, section G, subsection II, to the Convention

Paragraph 2 (Special cases), subparagraph (a)

The red bar of signs G, 2a and G, 2b shall be surrounded by a white rim.

25. Ad Annex 1, section G, subsection III, to the Convention

Paragraph 1

Sign G, 4c shall not be used.

Paragraph 2

Sign G, 6c shall not be used.

26. Ad Annex 1, section G, subsection V, to the Convention

Paragraph 3 (“NO THROUGH ROAD" sign)

The red bar of sign G, 13 shall be surrounded by a white rim.

27. Ad Annex 1, section H, to the Convention

Additional paragraph to be inserted immediately after paragraph 1

This paragraph shall be read as follows: “The ground of additional panels should be preferably the same as the ground of the particular groups of signs with which they are used".

Appendix to Annex to the European Agreement

Replace the words “Additional sign No. 1" and “Additional sign No. 2" by: “C,3m" and “C, 3n" respectively.

Insert new signs: E, 17a; E, 17b; F, 14; F, 15 and F, 16, which are reproduced at the end of this document.

„Toegevoegde alinea, in te voegen onmiddellijk na paragraaf b van dit artikel

Deze alinea wordt als volgt gelezen:

„ ,Woongebied': een speciaal ontworpen gebied waar bijzondere verkeersregels gelden en dat als zodanig door verkeerstekens wordt aangeduid bij de plaatsen waar men dat binnen- of uitrijdt."

9. Ad artikel 10 van het Verdrag (Voorrangstekens)

De eerste volzin van de tekst die betrekking heeft op het zesde lid, wordt als volgt gewijzigd:

„Zesde lid

Voor het geven van een vóórwaarschuwingsteken voor teken B,1, wordt hetzelfde teken gebruikt, aangevuld met een onderbord H,1, zoals omschreven in Bijlage 1, Deel H, bij dit Verdrag." (de rest van de tekst blijft ongewijzigd)

Het volgende nieuwe lid wordt toegevoegd:„9bis. Ad artikel 13bis van het Verdrag (Tekens die een bijzonder voorschrift inhouden)

Tweede lid

Dit lid wordt als volgt gelezen: „De tekens E,7a, E,7b of E,7c en E,8a, E,8b of E,8c wijzen de weggebruikers op het feit dat de algemene bepalingen die op het grondgebied van de Staat het verkeer in de bebouwde kom regelen, van toepassing zijn vanaf de tekens E,7a, E,7b of E,7c tot aan de tekens E,8a, E,8b of E,8c, behoudens afwijkende voorschriften, aangeduid door andere tekens op bepaalde weggedeelten in de bebouwde kom. Zij dragen opschriften in een donkere kleur op een wit of lichtgekleurd vlak en worden geplaatst respectievelijk waar men de bebouwde kom binnen- of uitrijdt. Teken B,4 wordt echter altijd geplaatst op een voorrangsweg die wordt aangegeven door middel van teken B,3 indien deze weg binnen de bebouwde kom ophoudt een voorrangsweg te zijn.

De bestaande tekst van paragraaf tien wordt vervangen door:

„10. Ad artikel 18 van het Verdrag (Tekens ter identificatie van een plaats of plek)

Op tekens ter identificatie van een plaats of plek dienen de opschriften in wit of in een lichte kleur te worden aangebracht op een donker vlak."

11. Ad artikel 23 van het Verdrag (Lichten voor het verkeer met voertuigen)

De teksten met de volgende titels vervallen:

„Toegevoegde alinea, in te voegen onmiddellijk na het derde lid van dit artikel";

„Negende lid"

„Tiende lid,"

De bestaande tekst van de paragrafen 17 t/m 33 van de Bijlage bij de Europese Overeenkomst wordt vervangen door:„17. Ad Bijlage 1, Deel A, Titel II, bij het Verdrag

Paragraaf 2 (Gevaarlijke nederwaartse helling)

Deze paragraaf wordt als volgt gelezen:

• „a. Teneinde te waarschuwen voor een steile nederwaartse helling dient symbool A,2a te worden gebruikt.

• b. Het linkerdeel van symbool A,2a dient in de linkerhoek van het bord te staan en de onderkant dient de hele breedte van het bord te beslaan; het cijfer geeft de hellingshoek aan in percenten uitgedrukt."

Paragraaf 3 (Steile opwaartse helling)

Deze paragraaf wordt als volgt gelezen:

• a. Ten einde te waarschuwen voor een steile opwaartse helling dient symbool A,3a te worden gebruikt.

• b Het rechterdeel van symbool A,3a dient in de rechterhoek van het bord te staan en de onderkant dient de hele breedte van het bord te beslaan; het cijfer geeft de hellingshoek aan in percenten uitgedrukt."

Paragraaf 12 (Voetgangersoversteekplaats)

Deze paragraaf wordt als volgt gelezen:

• a. De waarschuwing voor een voetgangersoversteekplaats dient te worden gegeven door symbool A,12a.

• b. Dit symbool mag in spiegelbeeld worden aangebracht.

Paragraaf 18 (Kruisingen waar de voorrang is zoals voorgeschreven bij de algemene voorrangsregel)

Deze paragraaf wordt als volgt gelezen: „De waarschuwing voor een kruising waar de voorrang is zoals voorgeschreven bij de algemene voorrangsregel die in het land van kracht is, dient te worden gegeven door symbool A,18a."

Paragraaf 20 (Kruisingen waarop aan de bestuurders op de kruisende weg voorrang moet worden verleend)

Deze paragraaf wordt als volgt gelezen: „Teken B,1 of teken B,2a dient te worden gebruikt overeenkomstig de bepalingen van punt 9 van deze Bijlage."

Paragraaf 22 (Kruising waarop het verkeer wordt geregeld door verkeerslichten)

Deze paragraaf wordt als volgt gelezen: „Indien het verkeer bij een kruising wordt geregeld door verkeerslichten, mag het teken Aa, met symbool A,17, zoals beschreven in paragraaf 17 hierboven, worden geplaatst ter aanvulling of vervanging van de tekens beschreven in de paragrafen 18 tot en met 21 hierboven."

Paragraaf 26 (Andere overwegen) Letter b.

Deze letter wordt als volgt gelezen: „De waarschuwing voor andere overwegen dient, afhankelijk van het geval, te worden aangegeven door symbool A,26a of A,27.

Paragraaf 28 (Tekens die nabij overwegen dienen te worden geplaatst)

Model A,28c van teken A,28 dient niet te worden gebruikt.

Modellen A,28a en A,28b mogen rode strepen hebben, mits hierdoor noch de algemene verschijningsvorm, noch de effectiviteit van de tekens wordt aangetast.

18. Ad Bijlage 1, Deel B, bij het Verdrag

Paragraaf 1 (Het teken VOORRANG VERLENEN)

Op teken B,1 mag geen symbool of opschrift worden aangebracht.

Paragraaf 2 (Het STOP-teken)

Deze paragraaf wordt als volgt gelezen: „Het „STOP-teken" dient teken B,2, model B,2a te zijn. Teken B,2, model B,2a is een achthoek met een rood vlak, omgeven door een smalle witte of licht gele rand, met daarop in het wit of licht geel het symbool „STOP"; de hoogte van het symbool dient ten minste een derde te zijn van de hoogte van het bord. De hoogte van het normale formaat van teken B,2a dient ongeveer 90 cm te zijn; de hoogte van de kleine tekens dient ten minste 60 cm te zijn."

19. Ad Bijlage 1, Deel C, Titel II, bij het Verdrag

Paragraaf 1 (Algeheel en beperkt inrijverbod)

Model C,1b van teken C,1 dient niet te worden gebruikt.

De twee tekens C,3m en C,3n weergegeven in het aanhangsel bij deze bijlage mogen worden gebruikt en hebben de volgende betekenis:

C,3m „VERBODEN IN TE RIJDEN VOOR VOERTUIGEN DIE MEER DAN EEN BEPAALDE HOEVEELHEID ONTPLOFBARE OF LICHT ONTVLAMBARE STOFFEN VERVOEREN"

c,3N „VERBODEN IN TE RIJDEN VOOR VOERTUIGEN DIE MEER DAN EEN BEPAALDE HOEVEELHEID STOFFEN VERVOEREN DIE WATERVERONTREINIGING KUNNEN VEROORZAKEN"

De Noot aan het einde van letter c wordt als volgt gelezen: „Tekens C,3a tot en met C,3l en tekens C,3m en C,3n vermeld onder dit punt, dienen geen schuine rode balk te bevatten."

Paragraaf 4 (Inhaalverbod)

De modellen C,13ab en C,13bb van de tekens C,13a en C,13b dienen niet te worden gebruikt.

Paragraaf 9, letter a, (ii)

Deze bepaling dient niet te worden toegepast.

Paragraaf 9, letter b, (iii)

Deze bepaling dient niet te worden toegepast.

Paragraaf 9, letter c, (v)

Van de mogelijkheid om, waar het verbod slechts over een kleine afstand van toepassing is, slechts één teken te plaatsen met daarop in een rode cirkel de afstand over welke het verbod van toepassing is, dient geen gebruik te worden gemaakt.

20. Ad Bijlage 1, Deel D, Titel I, bij het Verdrag

Paragraaf 2

Deze paragraaf wordt als volgt gelezen: „Tenzij anders wordt bepaald, dienen de tekens blauw te zijn met witte symbolen of met symbolen in een lichte kleur."

21. Ad Bijlage 1, Deel D, Titel II, bij het Verdrag

Paragraaf 1 (Verplichte rijrichting)

Teken D,1b dient niet te worden gebruikt.

Paragraaf 3 (Verplichte rijrichting op verkeersplein)

Deze paragraaf wordt als volgt gelezen: „Teken D,3 „VERPLICHTE RIJRICHTING OP VERKEERSPLEIN" dient geen andere betekenis te hebben dan het aangeven van de voorgeschreven rijrichting voor het rondrijdende verkeer met voertuigen."

22. Ad Bijlage 1, Deel E, Titel II, bij het Verdrag

Paragraaf 3 (teken „EENRICHTINGSWEG"), letter (a), (ii)

De pijl van teken E,3b mag alleen worden voorzien van een opschrift indien de doeltreffendheid van het teken daardoor niet wordt aangetast.

Paragraaf 5 (Tekens die het begin of het einde van een autosnelweg aangeven)

Toegevoegde letter, in te voegen onmiddellijk na letter (a) van deze paragraaf

Deze letter wordt als volgt gelezen: „Teken E,5a kan worden gebruikt en herhaald om te waarschuwen voor het begin van een autosnelweg. Elk teken dat hiertoe wordt geplaatst, dient te zijn voorzien van een opschrift op het onderste gedeelte waarmee de afstand wordt aangeduid tussen het teken en het begin van de autosnelweg, of van een onderbord H,1, zoals omschreven in Bijlage 1, Deel H, bij het Verdrag."

Paragraaf 6 (Tekens die het begin of het einde van een weg aangeven waarop dezelfde verkeersregels van toepassing zijn als op een autosnelweg)

Toegevoegde alinea, in te voegen onmiddellijk na letter (a) van deze paragraaf

Deze alinea wordt als volgt gelezen: „Teken E,6a mag worden gebruikt en herhaald om te waarschuwen voor de nadering van een weg waarop de verkeersregels hetzelfde zijn als op een autosnelweg. Elk teken dat hiertoe wordt geplaatst, dient te zijn voorzien van een opschrift op het onderste gedeelte waarmee de afstand wordt aangeduid tussen het teken en het begin van de weg waarop de verkeersregels hetzelfde zijn als op een autosnelweg, of een van onderbord H,1, zoals omschreven in Bijlage 1, Deel H, bij het Verdrag."

Paragraaf 7 (Tekens die het begin of het einde van een bebouwde kom aangeven)

Deze paragraaf wordt als volgt gelezen:

• „a. Op het teken waarmee het begin van een bebouwde kom wordt aangegeven, dient de naam van de bebouwde kom of het symbool met het silhouet van een bebouwde kom te worden aangebracht, of beide.

De opschriften dienen in een donkere kleur te zijn aangebracht op een wit of lichtgekleurd vlak en het teken dient een donkergekleurde rand te hebben.

Tekens E,7a, E,7b, en E,7c zijn voorbeelden van tekens waarmee het begin van een bebouwde kom wordt aangegeven.

• b. Het teken waarmee het einde van een bebouwde kom wordt aangegeven, dient identiek te zijn, behalve dat er een schuine roodgekleurde baan of parallel lopende roodgekleurde lijnen van de hoek rechtsboven naar de hoek linksonder lopen.

Tekens E,8a, E,8b, en E,8c zijn voorbeelden van tekens waarmee het einde van een bebouwde kom wordt aangegeven.

Onverminderd de bepalingen van artikel 6, eerste lid, van dit Verdrag, kunnen deze tekens worden aangebracht op de achterkant van de tekens die het begin van een bebouwde kom aangeven.

• c. De in dit Deel behandelde tekens dienen te worden gebruikt in overeenstemming met de bepalingen van artikel 13bis, tweede lid, van het Verdrag."

Paragraaf 10 (Voetgangersoversteekplaats)

Teken E,12b dient niet te worden gebruikt.

Paragraaf 12 (het teken „PARKEERGELEGENHEID")

Het vierkante bord genoemd in de eerste letter van deze paragraaf, dient te zijn voorzien van de letter „P".

Aan het einde van de tekst wordt toegevoegd:

„Toegevoegde paragraaf, in te voegen onmiddellijk na paragraaf 13

Deze paragraaf wordt als volgt gelezen:

"Tekens die een in- of uitrit aanduiden van een woongebied waar bijzondere verkeersregels van toepassing zijn

Teken E,17a „WOONGEBIED" dient te worden geplaatst op het punt waar de bijzondere regels die in een woongebied in acht moeten worden genomen en waarnaar wordt verwezen in artikel 27bis van het Verdrag inzake het wegverkeer, aangevuld met de Europese Overeenkomst, van toepassing worden. Teken E,17b „EINDE WOONGEBIED" dient te worden geplaatst op het punt waar de regels niet langer van toepassing zijn." "

23. Ad Bijlage 1, Deel F, Titel II, van het Verdrag

Paragraaf 1 (symbool „EERSTEHULPPOST")

De symbolen F,1b en F,1c dienen niet te worden gebruikt.

Paragraaf 2 (Diverse symbolen)

Aan het einde van de tekst wordt de volgende tekst toegevoegd:

„Toegevoegde symbolen in te voegen aan het einde van deze paragraaf

F,14 „RADIOSTATIONS DIE VERKEERSINFORMATIE VERSTREKKEN"

Opschrift op een wit vierkant: Onder het woord „radio" mag de naam of de code van het radiostation worden aangegeven, indien nodig in afgekorte vorm, alsmede het nummer van het programma. Het woord „Radio" kan eveneens in de nationale taal worden herhaald.

Opschrift op een blauw vlak: Aanduiding van de frequentie en, indien nodig, de golflengte van het lokale radiostation.

Het wordt aan de landen overgelaten om in geval van VHF-stations de aanduiding „MHz" of de regionale code toe te voegen, en in geval van middengolf- of langegolf-stations de aanduiding „kc/s".

De golflengte kan worden weergegeven in cijfers met de letter m (bijv. 1500m).

24. Ad Bijlage 1, Deel G, Titel II, bij het Verdrag

Paragraaf 2 (Bijzondere gevallen), letter (a)

The Federal Republic of Germany does not consider itself bound by paragraph 3 of the Annex (article 1, sub-paragraph (1) of the Convention).

Ad paragraph 15 of the Annex

(Article 33, paragraph 1, sub-paragraph (a), No. (i) of the Convention:

The Federal Republic of Germany does not consider itself bound by paragraph 15 of the Annex (article 33, paragraph 1, sub-paragraph (a), No. (i) of the Convention. (vertaling)

Voorts onder de mededeling dat de Overeenkomst mede voor het „Land" Berlijn zal gelden vanaf de datum waarop zij voor de Bondsrepubliek Duitsland geldt.

3 Onder het volgende voorbehoud:

“The Socialist Republic of Romania does not consider itself bound by the provisions of article 9 of the Agreement according to which any dispute between two or more Contracting Parties which relates to the interpretation or application of the Agreement and which the Parties in dispute are unable to settle by negotiations shall be referred to arbitration at the request of any of the Contracting Parties.

The Socialist Republic of Romania considers that such disputes may be referred to arbitration only with the consent of all parties in dispute for each case individually."(vertaling)

en onder de volgende verklaring:

2. The Socialist Republic of Romania considers that maintaining of the state of dependence of some territories to which reference is made in ..... article 3 of the European Agreement supplementing the Convention on Road Signs and Signals are not in keeping with the United Nations Charter and with the documents adopted by the U.N. concerning the granting of independence to the colonial countries and peoples, including the Declaration on the principles of international law concerning the friendly relations and the co-operation between States according to the United Nations Charter, and which has unanimously been adopted by the United Nations General Assembly resolution No. 2625 (XXV) of 24 October 1970 and which solemnly proclaims the States' obligation to further the implementation of the principle of equal rights for the peoples and their right to dispose of themselves, in order to put a speedy end to colonialism."

4 Onder de volgende verklaringen:

“1) With respect to Annex, paragraph 17 (amendment to Section B of Annex I, paragraphs 2 and 3 of the Convention: Signs indicating dangerous descent and steep ascent), Finland reserves the right to use sign A,2^c of the Convention to indicate a dangerous descent, instead of sign A,2^a. Similarly sign A,3^c of the Convention is used to indicate a steep ascent instead of sign A,3^a;

2) With respect to Article 11, paragraph 3, Finland notifies that the reservations Finland has made to Article 18, preamble and paragraph 4 and 5 of Section F of Annex 5 and paragraph 6 of Section F of Annex 5 of the Convention on Road Signs and Signals shall also apply to the European Agreement Supplementing the Convention."

en onder het volgende voorbehoud:

“With respect to Annex, paragraph 22 (amendment to the Note and Section A of Annex 4 of the Convention: Prohibition signs), Finland reserves the right to use an oblique red bar in signs corresponding to signs C,3^a-C,3^k of the Convention."

In verband met wijzigingen van de onderhavige Overeenkomst (zie rubriek J hieronder) heeft Finland op 5 september 1995 medegedeeld het hierboven genoemde voorbehoud mede toe te passen op de wijzigingen. Dientengevolge is het voorbehoud eveneens van toepassing op de nieuwe verkeerstekens C 3g tot C 3h en C 3m tot C 3n.

5 Onder een verklaring in overeenstemming met artikel 11, tweede lid:

“With respect to paragraph 22 of the Annex, signs C, 3a to C, 3k shall incorporate an oblique red bar."

onder een voorbehoud in overeenstemming met artikel 11, derde lid:

“The reservations of Sweden to the Convention on Road Signs and Signals also apply to this Agreement."

en onder het volgende voorbehoud:

“Sweden opposes that disputes in which it is involved shall be referred to arbitration."

6 Onder een voorbehoud in overeenstemming met artikel 11, derde lid, van de Overeenkomst:

“The reservations entered by Denmark concerning the Vienna Conventions shall apply to all five Conventions, and Protocol."

7 Onder de volgende voorbehouden:

“Ad number 9 of the annex (article 10, paragraph 6, of the Convention)

Switzerland reserves the right to make provision in its domestic legislation, to give advance warning of sign B, 2^a, for an identical sign supplemented by a panel conforming to model 1, reproduced in annex 7 to the Convention.

Ad numbers 10 and 27 of the annex (article 18, paragraph 2, and annex 5, section C, of the Convention)

Switzerland does not consider itself bound by the provisions of numbers 10 and 27 of the annex.

Ad number 12 of the annex (article 24, paragraph 2, of the Convention)

Switzerland reserves the right to make provision in its domestic legislation for the three-colour system for light signals for pedestrians, pursuant to article 24, paragraph 2, of the Convention.

Ad number 22 of the annex (annex 4, section A, number 2, letter (a) (iii), of the Convention)

Switzerland reserves the right to enact, in its domestic legislation, regulations specifying that access to roads marked by additional sign No. 1, reproduced in the appendix to the annex, is prohibited for vehicles transporting dangerous goods of any type."(vertaling)

In verband met wijzigingen van de onderhavige Overeenkomst (zie rubriek J hieronder) heeft Zwitserland op 23 mei 1995 de volgende mededeling gedaan:

“The reservations entered previously [with regard to the Agreement] are hereby abrogated and replaced by the following:

Annex, number 9 (article 10, paragraph 6, of the Convention)

Switzerland reserves the right to provide in its national legislation, as an advance warning sign for sign B 2^a, for an identical sign with an additional panel (model H, 1) as indicated in annex 1, section H.

Annex, numbers 9 bis and 22 (article 13 bis and annex 1, section E, subsection II, paragraph 7, of the Convention)

Switzerland does not consider itself bound by the provisions of numbers 9 bis and 22 of the annex.

Annex, paragraph 12 (article 24, paragraph 2, of the Convention)

Switzerland reserves the right to provide in its national legislation for the use of the three-colour system for light signals for pedestrians, in accordance with article 24, paragraph 2, of the Convention." (vertaling)

“In accordance with article 11, paragraph 1, of the Agreement the German Democratic Republic does not consider itself bound by the provisions of article 9 of the Agreement according to which a dispute which relates to the interpretation or application of the Agreement and which has not been settled by negotiation shall be referred to arbitration if any of the Contracting Parties in dispute so requests. The German Democratic Republic holds the view that in each case the consent of all Parties to the dispute is needed to settle a specific dispute by arbitration."(vertaling)

“The German Democratic Republic considers that the provisions of article 2 of the Agreement are inconsistent with the principle that all States pursuing their policies in accordance with the purposes and principles of the Charter of the United Nations shall have the right to become parties to conventions affecting the interests of all States.

The position of the German Democratic Republic with regard to the provisions of article 3 of the Agreement, as far as the application of the Agreement to colonial and other dependent territories is concerned, is governed by the provisions of the United Nations Declaration on the Granting of Independence to Colonial Countries and Peoples (Res. No. 1514 (XV) of 14 December 1960) proclaiming the necessity of bringing to a speedy and unconditional end colonialism in all its forms and manifestations." (vertaling)

1 Duitsland deelde op 26 mei 1995 het volgende mede:“The Federal Republic of Germany agrees to the proposals subject to the following reservation:

Reservation on Annex I, section C, subsection II, N^o 1 to the Convention.

The Federal Republic reserves the right to define the meaning of sign C, 3ⁿ “No entry for vehicles carrying more than a certain quantity of substances liable to cause water pollution" as follows:

“No entry for vehicles with a water endangering cargo."
