In verband met het uiteenvallen van Joegoslavië zijn op 25 februari en 21 april 1992 tussen de Regering van het Koninkrijk der Nederlanden en de Regering van Kroatië nota's gewisseld inzake de bilaterale verhoudingen. In deze nota's wordt geconstateerd dat alle voor 15 januari 1992 tussen het Koninkrijk der Nederlanden en de voormalige Socialistische Federatieve Republiek Joegoslavië gesloten verdragen, onder zekere voorbehouden, van toepassing blijven tussen Kroatië en het Koninkrijk der Nederlanden. (Voor de voor verdragen relevante passages uit de beide nota's zie Trb. 1995, 98, blz. 2).

Op 31 juli 1992 is te Ljubljana ondertekend een gezamenlijke verklaring van het Koninkrijk der Nederlanden en Slovenië met betrekking tot de bilaterale verdragsverhoudingen. In deze verklaring wordt vastgesteld dat o.a. de onderhavige Overeenkomst tussen het Koninkrijk der Nederlanden en Slovenië van kracht is gebleven (zie voor bedoelde verklaring Trb. 1995, 98, blz. 3 e.v.). Op 24 september 1996 is te Ljubljana een Verdrag met Slovenië inzake bevordering en bescherming van investeringen tot stand gekomen (zie voor dat Verdrag rubriek J hieronder). Bedoeld Verdrag is nog niet in werking getreden.

Voorts zijn op 11 juli 1994 nota's gewisseld tussen de Regering van het Koninkrijk der Nederlanden en de Regering van De Voormalige Joegoslavische Republiek Macedonië waarin wordt bevestigd de voortgezette toepassing van bilaterale verdragen tussen het Koninkrijk der Nederlanden en De Voormalige Socialistische Federatieve Republiek Joegoslavië (zie voor die nota's rubriek J hieronder).

De onderhavige Overeenkomst is in overeenstemming met artikel 102 van het Handvest der Verenigde Naties op 30 juni 1977 geregistreerd bij het Secretariaat der Verenigde Naties onder nr. 15779. De tekst van Overeenkomst en brieven, alsmede een vertaling in het Frans, is afgedrukt in „Recueil des Traités" van de Verenigde Naties, deel 1047, blz. 370 e.v.

Voor de op 13 maart 1968 te Belgrado tot stand gekomen Overeenkomst inzake economische, industriële en technische samenwerking tussen het Koninkrijk der Nederlanden en de Socialistische Federale Republiek Zuidslavië zie ook Trb. 1997, 221.

Op 24 september 1996 is te Ljubljana tot stand gekomen het Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Slovenië inzake de bevordering en de wederzijdse bescherming van investeringen. De tekst van dat Verdrag is geplaatst in Trb. 1996, 296. Dat Verdrag is nog niet in werking getreden; het zal bij inwerkingtreding de onderhavige Overeenkomst vervangen in de verhouding Koninkrijk der Neder- landen–Slovenië.

Op 27 juni en 11 juli 1994 zijn te Skopje en 's-Gravenhage nota's gewisseld tussen de Regering van De Voormalige Joegoslavische Republiek Macedonië en de Regering van het Koninkrijk der Nederlanden inzake de bilaterale verdragsverhoudingen. De tekst van de nota's luidt als volgt:

The Ministry of Foreign Relations of the Republic of Macedonia presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and, with reference to its Note of 1 November 1993 notifying that the Republic of Macedonia accepts as its own all valid international agreements of the former Socialist Federal Republic of Yugoslavia, and all bilateral and multilateral conventions with the Kingdom of the Netherlands.

Wishing to promote the relations between the Republic of Macedonia and the Kingdom of the Netherlands and reaffirming the attitude that the bilateral agreements that have been into force between the former SFRY and the Kingdom of the Netherlands should continue to be applied in the relations between the two countries, except if in any of these agreements or if stipulated elsewhere that the implementation of any agreement shall radically change the terms of their implementation, or if the two countries agree otherwise, the Ministry of Foreign Relations has the honour to propose that the following agreements concluded between the former Socialist Federal Republic of Yugoslavia and the Kingdom of the Netherlands represent agreements concluded between the Republic of Macedonia and the Kingdom of the Netherlands in the future:

1. Agreement on the Extradition of Criminals, Belgrade, 28 February/11 March 1896, entered into force on 28 January 1897;

2. Convention on Trade and Navigation, Belgrade, 28 May 1930, entered into force on 17 April 1932;

3. Convention on the Settlement of Disputes Through Adjudication, Arbitration or Conciliation, The Hague, 11 March 1931, entered into force on 2 April 1932;

4. Exchange of Notes Concerning the Reciprocal Submission of Information on Criminal Sentences Against Foreigners (Reciprocity Regulation), Belgrade, 9 October 1953/8 June 1954;

5. Agreement on Compensation for Interest of the Netherlands in Yugoslavia Which Have Been Affected by Nationalization Measures, Belgrade, 22 July 1958, entered into force on 25 August 1959;

6. Agreement Concerning the Regulation of Certain Financial Claims of the Netherlands, The Hague, 9 Febuary 1961, entered into force on 21 November 1961;

7. Cultural Agreement Between the Kingdom of the Netherlands and the Socialist Federal Republic of Yugoslavia, Belgrade, 11 August 1966, entered into force on 29 May 1967;

8. Agreement Concerning International Road Transport, Belgrade, 8 September 1966, entered into force on 4 April 1967;

9. Agreement Concerning Economic, Industrial and Technical Cooperation, Belgrade, 13 March 1968, entered into force on 12 August 1968;

10. Agreement Between the Government of the Kingdom of the Netherlands and the Government of the Socialist Federal Republic of Yugoslavia Concerning the Regulation of the Employment of Yugoslav Workers in the Netherlands, Belgrade, 9 March 1970, entered into force on 11 June 1970;

11. Exchange of Notes to Supplement the Agreement Concerning International Road Transport With Article 7 bis, Belgrade, 20 November 1972, entered into force on 15 November 1973;

12. Agreement on the Protection of Investments Between the Kingdom of the Netherlands and the Socialist Federal Republic of Yugoslavia, Belgrade, 16 February 1976, entered into force on 1 April 1977;

13. Convention Between the Kingdom of the Netherlands and the Socialist Federal Republic of Yugoslavia on Social Security, Belgrade, 11 May 1977, entered into force on 1 April 1979;

14. Administrative Arrangement Concerning the Modalities of Application of the Convention on Social Security, Belgrade, 16 May 1977, entered into force on 1 April 1979;

15. Convention Between the Kingdom of the Netherlands and the Socialist Federal Republic of Yugoslavia for the Avoidance of Double Taxation With Respect to Taxes on Income and Capital, with Protocol, Belgrade, 22 February 1982, entered into force on 6 February 1983.

The Ministry of Foreign Relations has the honour to propose that the Agreement between the former SFRY and the Kingdom of the Netherlands concerning Regular Air Sevices, of 13 March 1957, and the Agreement between the former SFRY and the Kingdom of the Netherlands on Technical Cooperation Aiming at the Creation of Conditions for the Promotion of Employment in Economically Underdeveloped Areas of Yugoslavia, of 20 January 1977, be canceled between the Republic of Macedonia and the Kingdom of the Netherlands in the future, due to the changed circumstances in the relations between the two countries.

In case the Ministry of Foreign Affairs of the Kingdom of the Netherlands accepts the proposal contained herein, the Ministry of Foreign Relations of the Republic of Macedonia will consider the receipt of the Note of the Ministy of Foreign Affairs of the Kingdom of the Netherlands confirming the acceptance of the proposal as an agreement that the conventions between the former SFRY and the Kingdom of the Netherlands mentioned in this Note, constitute agreements between the Republic of Macedonia and the Kingdom of the Netherlands.

The Ministry of Foreign Relations of the Republic of Macedonia avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Relations of The Former Yugoslav Republic of Macedonia and, has the honour to acknowledge receipt of its Note No. 1506-3890/1 of 27 June 1994, which reads as follows.

The Ministry accepts the proposal of the Ministry of Foreign Relations of The Former Yugoslav Republic of Macedonia and confirms that its Note and this reply confirm that the agreements between the Socialist Federal Republic of Yugoslavia and the Kingdom of the Netherlands mentioned above under numbers 1 to 15, continue to be in force between The Former Yugoslav Republic of Macedonia and the Kingdom of the Netherlands and further that the Agreement concerning Regular Air Services of 13 March 1957 and the Agreement on Technical Cooperation Aiming at the Creation of Conditions for the Promotion of Employment in Economically Underdeveloped Areas of Yugoslavia of 20 January 1977 are no longer in force.

The Ministry avails itself of this opportunity to renew to the Ministry of Foreign Relations of The Former Yugoslav Republic of Macedonia the assurances of its highest consideration.
