De Overeenkomst, zoals gewijzigd, is van toepassing gebleven in de betrekkingen tussen het Koninkrijk der Nederlanden en de Republiek Kroatië (zie rubriek J hieronder) en de Republiek Slovenië (zie rubriek J hieronder).

De onderhavige Overeenkomst zal op 1 juni 1995 buiten werking treden wat betreft de betrekkingen tussen het Koninkrijk der Nederlanden en de Republiek Kroatië ingevolge artikel 10, eerste lid, van het in rubriek J hieronder genoemde Verdrag van 20 september 1994.

In overeenstemming met artikel 102 van het Handvest van de Verenigde Naties is de in de nota's van 20 november 1972 vervatte overeenkomst geregistreerd bij het Secretariaat der Verenigde Naties op 28 februari 1974 onder nr. 8643. De tekst van de nota's, alsmede een vertaling in het Engels, is afgedrukt in het „Recueil des Traités" van de Verenigde Naties, deel 918, blz. 164 e.v.

Op 25 februari en 21 april 1992 zijn nota's gewisseld tussen de Nederlandse en de Kroatische Regering inzake de bilaterale verhoudingen. Voor de onderhavige Overeenkomst relevante passages uit de beide nota's luiden als volgt:

“.... In compliance with the Constitutional Decision on the Sovereignty and Independence of the Republic of Croatia and the Law on the Conclusion and Implementation of International Agreements, as of October 8, 1991, all international agreements concluded by the former SFR Yugoslavia were taken over by the Republic of Croatia, who will continue to implement them unless they are in contradicton with the Constitution and the legal system of the Republic of Croatia ..."

“.... The Government of the Kingdom of the Netherlands welcomes the decision of the Republic of Croatia to continue to perform the rights and fulfill the obligations under the international agreements concluded by the SFR Yugoslavia.

The Government of the Kingdom of the Netherlands subscribes to the continued application of all treaties, unless it appears from the relevant treaty or is otherwise established that the application of a treaty would be incompatible with the object and purpose of the treaty or would radically change the conditions for its operation.

The Government of the Kingdom of the Netherlands therefore concludes that, subject to the foregoing proviso all bilateral treaties, concluded by the SFR Yugoslavia before 15 January 1992, continue to apply as from that date between the Republic of Croatia and the Kingdom of the Netherlands...."

Op 31 juli 1992 is te Ljubljana ondertekend een gezamenlijke verklaring van het Koninkrijk der Nederlanden en Slovenië met betrekking tot de bilaterale verdragsverhoudingen. De tekst van die verklaring luidt als volgt:

Joint Declaration on Bilateral Treaty Relations

The Minister of Foreign Affairs of the Kingdom of the Netherlands and the Minister of Foreign Affairs of the Republic of Slovenia;

Referring to the note of the Ministry of Foreign Affairs of the Republic of Slovenia of 18 March 1992 and the note of the Ministry of Foreign Affairs of the Kingdom of the Netherlands of 21 April 1992;

Reaffirm the principle of the continuation of the application in the relation between the Kingdom of the Netherlands and the Republic of Slovenia of all bilateral treaties listed in the annex which were in force between the Kingdom of the Netherlands and the former Socialist Federal Republic of Yugoslavia, unless it appears from a treaty or is otherwise established that the application of a treaty would radically change the conditions for its operation or unless both States otherwise agree;

Note with satisfaction that thus as a mutual interest for both States treaties such as the Agreement on the extradition of criminals (Belgrade 28 February/11 March 1896), the Agreement concerning economic, industrial and technical cooperation (Belgrade 13 March 1968), the Agreement concerning the regulation of the employment of Yugoslav workers in the Netherlands (Belgrade 9 March 1970), the Agreement on the protection of investment between the Kingdom of the Netherlands and the Socialist Federal Republic of Yugoslavia (Belgrade 16 February 1976), the Convention and Administrative arrangement on social security (Belgrade 11 and 16 May 1977) and the Convention for the avoidance of double taxation with respect to taxes on income and capital, with a Protocol (Belgrade 22 February 1982) have remained in force;

Agree that all practical measures necessary to implement the bilateral treaties, will be taken as soon as possible;

Agree to examine jointly whether any further measures must be taken with regard to the treaties in force;

Agree furthermore that the Kingdom of the Netherlands and the Republic of Slovenia strive at the conclusion of new treaties where they deem it appropriate or the replacement of certain treaties by new treaties such as in the field of the road and air transport.

Op 20 september 1994 is te Zagreb tot stand gekomen het Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Kroatië inzake internationaal vervoer over de weg. Tekst en vertaling van het Verdrag zijn geplaatst in Trb. 1995, 9; zie ook Trb. 1995, 99.

Op 17 mei 1993 is te Ljubljana tot stand gekomen een Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Slovenië inzake internationaal vervoer over de weg, welk Verdrag vanaf 17 mei 1993 voorlopig wordt toegepast. Tekst en vertaling van het Verdrag zijn geplaatst in Trb. 1993, 113.
