De overeenkomst met Spanje (zie rubriek H) zal ingevolge het in de nota's gestelde op 1 februari 1995 in werking treden.

De overeenkomst met het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland (zie rubriek H) zal ingevolge het in de brieven gestelde in werking treden op de datum waarop de Verdragspartijen elkaar hebben medegedeeld dat aan de nationale voorwaarden voor het van kracht worden van de overeenkomst is voldaan.

H. TOEPASSELIJKVERKLARING

In Tractatenblad 1994, 218 dient het eerste gedeelte van de laatste regel ten rechte te luiden:

„wet naar de tekst van 1972.".

Bij notawisseling tussen de Nederlandse en de Spaanse Regering is op 24 november 1994 een overeenkomst als bedoeld in artikel 27, vierde lid, van het onderhavige Verdrag tot stand gekomen betreffende de uitbreiding van het Verdrag tot de Nederlandse Antillen en Aruba. De tekst van de nota's luidt als volgt:

Note Verbale

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Kingdom of Spain and has the honour to inform the Ministry that the Netherlands Government proposes that the application of the European Convention on Extradition of 13 December 1957, in accordance with article 27, paragraph 4, be extended to the Netherlands Antilles and Aruba, that the declarations and reservations that apply in relations between the Kingdom of the Netherlands, in respect of the Kingdom in Europe, and the Kingdom of Spain shall also apply in relations between the Kingdom of Spain and the Kingdom of the Netherlands in respect of the Netherlands Antilles and Aruba, and that the declaration concerning articles 6 and 21 as made by the Kingdom of the Netherlands upon ratification of the Convention on 14 February 1969 and as amended on 14 October 1987 shall apply to the Netherlands Antilles and Aruba respectively, with regard to the extradition of Netherlands nationals, only when the European Convention on the Transfer of Sentenced Persons, concluded in Strasbourg on 21 March 1983, becomes applicable to the Netherlands Antilles and Aruba respectively.

If this proposal is acceptable to the Government of the Kingdom of Spain, the Embassy has the honour further to propose that this Note and the Ministry's affirmative reply, shall constitute an arrangement as provided for in article 27, paragraph 4, of the Convention, which shall enter into force on the first day of the third month following the date on which the Embassy receives the Ministry's reply.

The Embassy of the Kingdom of the Netherlands takes this opportunity to renew to the Ministry of Foreign Affairs the assurances of its highest consideration.

Nota Verbal

El Ministerio de Asuntos Exteriores saluda atentamente a la Embajada del Reino de los Países Bajos en Madrid, y tiene la honra de referirse a su Nota Verbal de fecha 11 de noviembre de 1993, que tiene el siguiente texto:

»La Embajada del Reino de los Países Bajos presenta sus saludos al Ministerio de Asuntos Exteriores del Reino de España y tiene el honor de informarle de que el Gobierno de los Países Bajos propone que la aplicación del Convenio Europeo de Extradición de 13 de diciembre de 1957, de conformidad con el párrafo 4 del artículo 27, se haga extensiva a las Antillas Neerlandesas y Aruba, que las declaraciones y reservas que sean aplicables a las relaciones entre el Reino de los Países Bajos, con respecto al Reino en Europa, y el Reino de España sean también aplicables a las relaciones entre el Reino de España y el Reino de los Países Bajos con respecto a las Antillas Neerlandesas y Aruba, y que la declaración relativa a los artículos 6 y 21 formulada por el Reino de los Países Bajos en el momento de ratificación del Convenio el 14 de febrero de 1969 y modificada el 14 de octubre de 1987 sea aplicable a las Antillas Neerlandesas y Aruba respectivamente, con respecto a la extradición de nacionales de los Países Bajos, únicamente cuando el Convenio Europeo sobre Traslado de Personas Condenadas, concluido en Estrasburgo el 21 de marzo de 1983, llegue a ser aplicable a las Antillas Neerlandesas y Aruba respectivamente.

Si la presente propuesta resulta aceptable para el Gobierno del Reino de España, la Embajada tiene el honor de proponer asímismo que la presente Nota y la respuesta afirmativa del Ministerio constituyan un Acuerdo según lo previsto en el párrafo 4 del artículo 27 del Convenio, que entrará en vigor el primer dia del tercer mes siguiente a la fecha en que la Embajada reciba la respuesta del Ministerio.«

El Ministerio de Asuntos Exteriores tiene la honra de comunicar a esa Embajada que el Ministerio de la Presidencia informa que el Congreso de los Diputados con fecha 20.9.94 y el Senado con fecha 20.10.94 han expresado su autorización para que el Reino de España acepte la extensión a las Antillas Neerlandesas y a Aruba del Convenio Europeo no 24 de Extradición, en los términos de la referida Nota de esa Embajada de fecha 11.11.93.

El Ministerio de Asuntos Exteriores aprovecha esta oportunidad para reiterar a la Embajada del Reino de los Países Bajos en Madrid el testimonio de su más distinguida consideración.

On instructions from my Government, I have the honour to propose that the application of the European Convention on Extradition („the Convention") of 13 December 1957, in accordance with Article 27, paragraph 4 thereof, be extended to the Netherlands Antilles and Aruba.

The declarations and reservations made by the Kingdom of The Netherlands, in respect of the Kingdom in Europe, and the United Kingdom of Great Britain and Northern Ireland on becoming parties to the Convention and which apply to extradition relations between them shall also apply to extradition relations between the United Kingdom and the Kingdom of the Netherlands in respect of the Netherlands Antilles and Aruba, except that the declaration concerning Articles 6 and 21 as made by the Kingdom of the Netherlands upon ratification and amended on 14 October 1987, relating to the extradition of Netherlands nationals, shall not apply to the Netherlands Antilles nor to Aruba respectively until such time as the European Convention on the Transfer of Sentenced Persons, concluded in Strasbourg on 21 March 1983, becomes applicable to each of them respectively.

If this proposal is acceptable to the Government of the United Kingdom, I have the honour to propose that this letter and Your Excellency's reply to that effect shall constitute an Agreement between our two Governments which shall enter into force on the date on which each of our two Governments has notified the other of the completion of its internal procedures necessary to give effect to it.

De hierboven afgedrukte overeenkomsten behoeven niet de goedkeuring van de Staten-Generaal ingevolge respectievelijk artikel 7, onderdeel a, (wat betreft Aruba) en artikel 7, onderdeel b, (wat betreft de Nederlandse Antillen) van de Rijkswet goedkeuring en bekendmaking verdragen.

Op 12 december 1994 heeft het Koninkrijk der Nederlandende op 14 oktober 1987 afgelegde verklaring als volgt aangevuld: „(.... is requested) and in so far as such foreigners are not expected to lose their right of residence in the Kingdom as a result of the imposition of a penalty or measure subsequent to their extradition.".
