Overeenkomst tussen het Koninkrijk der Nederlanden en Jamaica inzake technische samenwerking;

Ter uitvoering van artikel I, derde lid, van de onderhavige Overeenkomst is te Kingston op 22 december 1994 tussen de bevoegde Nederlandse en Jamaicaanse autoriteiten een administratief akkoord tot stand gekomen inzake een project betreffende het verbeteren en vergroten van inkomstgenererende activiteiten en werkgelegenheid middels het ontwikkelen van de micro- en kleinbedrijf sector. De tekst van het akkoord luidt als volgt:
The Netherlands Minister for Development Cooperation, being the competent Netherlands Authority for the purpose of this Administrative Arrangement, hereinafter referred to as “the Netherlands Party", represented in this matter by the Ambassador Extraordinary and Plenipotentiary of Her Majesty the Queen of the Netherlands,
and
the Jamaican Minister of Finance, being the competent Jamaican Authority for the purpose of this Administrative Arrangement, hereinafter reffered to as “the Jamaican Party",
With regard to the provisions of Article I of the Agreement of Technical Cooperation between the Kingdom of the Netherlands and the Government of Jamaica, signed in Kingston on the 29th of June 1993, hereinafter referred to as the “Agreement",
Have entered into the following Administrative Arrangement:
1. The two Parties shall jointly carry out a project, to be known as “Micro Enterprise Development Project, Phase 2", hereinafter referred to as “the Project".
2. The objective of the Project is to improve and increase income-earning opportunities and employment through the creation of new and the expansion of existing micro and small enterprises.
3. This objective shall be pursued by the Office of the Prime Minister of Jamaica.
4. The cooperation between the two Parties is planned to last for a period of 4 years.
1. The Netherlands Party shall make the following contribution to the Project: financial support of activities to be undertaken by the Office of the Prime Minister, CAST and the Wholesale Banking Institution, and technical assistance and monitoring to assist with project implementation.
2. The value of the Netherlands contribution to the implementation of the Project will not exceed a total amount of 9.667.200 Netherlands guilders.
1. The Jamaican Party shall make the following contribution to the Project: provision of services (management and administration of the project), provision of adequate project office accommodation and a financial contribution to the project credit facility.
2. The total value of the Jamaican contribution for the first year is estimated at the amount of 12.000.000 Jamaican Dollars, of which 8.000.000 Jamaican Dollars is earmarked for the provision of credit and the remainder for the provision of services.
1. The Netherlands Party shall appoint the Directorate-General of International Cooperation of the Netherlands Ministry of Foreign Affairs as the Netherlands Executive Authority in charge of the implementation of the Project.
2. The Jamaican Party shall appoint the Office of the Prime Minister as the Jamaican Executive Authority in charge of the implementation of the Project.
Each of the Executive Authorities shall be entitled to delegate the duties in connection with the Project under its responsibility partly or entirely to other authorities or organizations. The Executive Authorities shall inform each other in writing of any such delegation and of the extent of the delegation.
1. The Netherlands Executive Authority shall be represented in Jamaica, as far as the day to day operations of the Project are concerned, by the Netherlands Project Advisor. The Project Advisor shall act in close cooperation with the Jamaican Executive Authority and its representative, and will respect the operational instructions given by the said Authority to the Jamaican personnel.
The Netherlands Project Advisor shall be responsible to the Permanent Secretary of the Office of the Prime Minister and the Netherlands Executive Authority for the correct implementation of the Netherlands contribution to the Project.
2. The Jamaican Executive Authority shall be represented, as far as the day to day operations of the Project are concerned by the officer appointed by the Office of the Prime Minister, who will be the Jamaican Project Manager.
The Jamaican Project Manager shall be responsible to the Jamaican Executive Authority for the correct implementation of the Jamaican contribution to the Project.
1. The Executive Authorities shall establish by mutual consent a Project Document stating in detail the contribution of either Party, the number and duties of the personnel, their job-descriptions, a time-table and a list of equipment and materials to be supplied by either Party.
2. The Project Document may be amended by mutual consent by the Executive Authorities.
3. The Project Document shall form an integral part of this Administrative Arrangement.
The Netherlands personnel shall enjoy the privileges and immunities described in Articles II and III of the Agreement.
The provision of Article VII of the Agreement is applicable to the importation of the equipment and materials provided by the Netherlands Party under the project.
Upon completion of the project the ownership of the equipment and materials of the project and materials shall be transferred to the Government of Jamaica unless otherwise agreed between the Executive Authorities.
The Project Manager and the Project Advisor shall jointly submit to the Executive Authorities quarterly reports in English on the progress made on the implementation of the Project. On the termination of the Project they shall submit to all parties involved a final report in English on all aspects of the work executed in connection with the Project.
1. In the second year of the Project implementation an evaluation will be conducted.
2. The composition of the evaluation missions will be defined jointly by the Executive Authorities.
Any dispute concerning the interpretation or implementation of this Administrative Arrangement which cannot be settled by consultations between the two Parties shall be referred to the respective Governments.
This Administrative Arrangement shall enter into force with retroactive effect as of July 26, 1994 (being the date of signature of the Letter of Commitment by both Parties) and shall expire either at the end of the period stated in Article I, paragraph 4, of this Arrangement or on the date on which the Project has been completed in conformity with the provisions of this Arrangement and of the Working Document whichever date is the later.
