De Inspecteur-Generaal, Hoofd van de Scheepvaartinspectie, genoemd in artikel 10 van de Schepenwet, en het Hoofd van de Scheepvaartinspectie in het Land Curaçao;
Gezien de instemming met de hierna omschreven mandaatverlening, welke instemming deel uitmaakt van de Overeenkomsten van 13 juni 2012 betreffende de machtiging tot het verrichten van onderzoeken, alsmede de certificering van schepen geregistreerd in Curaçao die de vlag van het Koninkrijk voeren;
Besluiten:
1. De bevoegdheid, bedoeld in artikel 6, eerste lid, van de Schepenwet, van het Hoofd van de Scheepvaartinspectie tot het afgeven van certificaten voor schepen met een Curaçaose zeebrief, voorzover deze certificaten zijn omschreven in de Appendix bij Bijlage I van de Overeenkomsten van 13 juni 2012 tussen het Land Curaçao en het Koninkrijk der Nederlanden enerzijds en de door de Minister van Infrastructuur en Milieu, op grond van artikel 6, tweede lid, van deze rijkswet, aangewezen klassenbureaus anderzijds, wordt gemandateerd aan:
a. de President en Chief Executive Officer van het American Bureau of Shipping (ABS) te Houston, Verenigde Staten van Amerika;
b. de Secretary van Bureau Veritas (BV) te Neuilly-sur-Seine, Frankrijk;
c. de Chief Operating Officer van Det Norske Veritas Maritime (DNV) te Oslo, Noorwegen;
d. de Executive Board van Germanischer Lloyd (GL) SE te Hamburg, Duitsland;
e. de Marine Business Director van Lloyds Register EMEA (LR) te Londen, Verenigd Koninkrijk;
f. de General Manager van het Classification Department en de General Manager van het Safety Management Systems Department van Nippon Kaiji Kyokai (NK) te Tokio, Japan;
g. de Director, Technical Affairs van RINA Services S.p.A. te Genua, Italië.
2. De in artikel 7, derde lid, van de Schepenwet bedoelde bevoegdheid van de ambtenaren van de Scheepvaartinspectie tot het intrekken van certificaten van schepen met een Curaçaose zeebrief, voorzover deze certificaten zijn omschreven in de Appendix bij Bijlage I van de Overeenkomsten van 13 juni 2012 tussen het Land Curaçao en het Koninkrijk der Nederlanden enerzijds en de door de Minister van Infrastructuur en Milieu, op grond van artikel 6, tweede lid, van deze rijkswet, aangewezen klassenbureaus anderzijds, wordt gemandateerd aan de personen, genoemd in het eerste lid.
1. De in artikel 10, eerste lid, van de Landsverordening voorkoming verontreiniging door schepen bedoelde bevoegdheid van het Hoofd van de Scheepvaartinspectie tot het afgeven van certificaten voor schepen met een Curaçaose zeebrief, voorzover deze certificaten zijn omschreven in de Appendix bij Bijlage I van de Overeenkomsten van 13 juni 2012 tussen het Land Curaçao en het Koninkrijk der Nederlanden enerzijds en de door de Minister van Infrastructuur en Milieu, op grond van artikel 6, tweede lid, van de Schepenwet, aangewezen klassenbureaus anderzijds, wordt gemandateerd aan de personen, genoemd in artikel 1, eerste lid.
2. De in artikel 11, tweede lid, van de Landsverordening voorkoming verontreiniging door schepen bedoelde bevoegdheid, onder de daarin beschreven omstandigheden, van de bevoegde ambtenaar van de Scheepvaartinspectie tot het intrekken van certificaten van schepen met een Curaçaose zeebrief, voorzover deze certificaten zijn omschreven in de Appendix bij Bijlage I van de Overeenkomsten van 13 juni 2012 tussen het Land Curaçao en het Koninkrijk der Nederlanden enerzijds en de door de Minister van Infrastructuur en Milieu, op grond van artikel 6, tweede lid, van de Schepenwet, aangewezen klassenbureaus anderzijds, wordt gemandateerd aan de personen, genoemd in artikel 1, eerste lid.
1. De in artikel 4, tweede lid, van de Meetbrievenlandsverordening 1986 bedoelde bevoegdheid van het Hoofd van de Scheepsmetingsdienst tot het afgeven van meetbrieven, voorzover deze zijn omschreven in de Appendix bij Bijlage I van de Overeenkomsten van 13 juni 2012 tussen het Land Curaçao en het Koninkrijk der Nederlanden enerzijds en de door de Minister van Infrastructuur en Milieu, op grond van artikel 6, tweede lid, van de Schepenwet, aangewezen klassenbureaus anderzijds, wordt gemandateerd aan de personen, genoemd in artikel 1, eerste lid.
2. De in artikel 9, eerste lid, van de Meetbrievenlandsverordening bedoelde bevoegdheid van het Hoofd van de Scheepsmetingsdienst tot het intrekken van een Internationale Meetbrief (1969), voorzover deze is omschreven in de Appendix bij Bijlage I van de Overeenkomsten van 13 juni 2012 tussen het Land Curaçao en het Koninkrijk der Nederlanden enerzijds en de door de Minister van Infrastructuur en Milieu, op grond van artikel 6, tweede lid, van de Schepenwet, aangewezen klassenbureaus anderzijds, wordt gemandateerd aan de personen, genoemd in artikel 1, eerste lid.
1. Een besluit tot afgifte, een besluit tot weigering van afgifte en een besluit tot intrekking van een document als bedoeld in dit besluit, wordt door de personen, genoemd in artikel 1, eerste lid, aan de betrokkene uitgereikt door middel van een door het Hoofd van de Scheepvaartinspectie in Curaçao voorgeschreven standaardbeschikking.
2. Een besluit tot intrekking van een document als bedoeld in dit besluit, wordt uitsluitend genomen in overleg met het Hoofd van de Scheepvaartinspectie in Curaçao.
De personen, genoemd in artikel 1, eerste lid, voeren bij de uitoefening van het aan hen verleende mandaat een ordentelijke administratie.
De personen, genoemd in artikel 1, eerste lid, nemen bij de uitoefening van het aan hen verleende mandaat de instructies van het Hoofd van de Scheepvaartinspectie in Curaçao in acht.
De personen, genoemd in artikel 1, eerste lid, kunnen wat betreft de aan hen in mandaat verleende bevoegdheden, binnen hun organisatie ondermandaat verlenen aan leidinggevenden en andere personen door hen daartoe aangewezen. Zij stellen het Hoofd van de Scheepvaartinspectie in Curaçao daarvan tevoren schriftelijk in kennis.
Dit mandaatbesluit wordt aangehaald als: Gezamenlijk Besluit van de Inspecteur-Generaal, Hoofd van de Scheepvaartinspectie, en het Hoofd van de Scheepvaartinspectie in Curaçao tot het verlenen van mandaat aan erkende organisaties met betrekking tot de certificering van schepen geregistreerd in Curaçao.
Dit besluit zal door tussenkomst van de Minister van Algemene Zaken van Curaçao met de toelichting in de Curaçaosche Courant worden geplaatst, alsook in de Staatscourant in Nederland. Het zal in afschrift worden gezonden aan de gemandateerden.

In lijn met hetgeen sinds enige tijd wereldwijd gezien in de scheepvaartwereld gebruikelijk is, is na afstemming met de sector besloten tot verdere uitbesteding van de onderzoeken en inspecties van zeeschepen aan de door de Minister van Infrastructuur en Milieu, op grond van de Schepenwet, aangewezen en gemachtigde klassenbureaus. Het betreft de in Curaçao geregistreerde zeeschepen, die de vlag van het koninkrijk der Nederlanden voeren en bij de gemachtigde klassenbureaus zijn geklasseerd. Het gaat hierbij om alle onderzoeken en inspecties die zijn voorgeschreven in de voor het land Curaçao geldende verdragen, alsook in de Schepenwet, de Landsverordening voorkoming verontreiniging door schepen en de Meetbrievenlandsverordening 1986.
Voorts is besloten de afgifte van nagenoeg alle kortlopende, internationaal voorgeschreven certificaten, met inbegrip van vrijstellingen, aan deze erkende organisaties te mandateren. Niet gemandateerd zijn de afgifte van ondermeer de zeebrief en het zogeheten Safe Manning Document, een eveneens internationaal voorgeschreven bemanningsdocument. In de Appendix van Annex I bij de overeenkomst (zie bijlage) is gedetailleerd weergegeven wat de taakverdeling is tussen de klassenbureaus en de Scheepvaartinspectie.
Ook zijn de klassenbureaus gemachtigd om certificaten namens de vlaggenstaat in te trekken maar dit is uiteraard met de nodige waarborgen omkleed. Ingevolge het onderhavige besluit en de overeenkomsten dient het betreffende klassenbureau alvorens – in mandaat – een beslissing omtrent intrekking te nemen, in overleg te treden met de Scheepvaartinspectie op Curaçao.
De uitbesteding aan de erkende organisaties met de bijbehorende machtiging is vastgelegd en uitgewerkt in een zevental gelijkluidende overeenkomsten tussen het Land Curaçao en het Koninkrijk der Nederlanden enerzijds en de desbetreffende internationaal opererende klassenbureaus anderzijds. Hun instemming met de mandatering van de beslissingsbevoegdheid aangaande de eerder bedoelde certificaten is in deze overeenkomsten opgenomen.
De overeenkomst vervangt de in 1996 gesloten en in 2000 gewijzigde overeenkomst die toen van toepassing was op schepen geregistreerd in Nederland, Aruba en de Nederlandse Antillen.
Nederland heeft per 1 juni 2006 nieuwe overeenkomsten met de genoemde klassenbureaus gesloten tot verdere uitbesteding van de inspecties van in Nederland geregistreerde zeeschepen. Voorts is toen ook de afgifte van statutaire certificaten aan deze organisaties gemandateerd.
De mandaatverlening is vormgegeven als een gezamenlijk besluit van de Inspecteur-Generaal, Hoofd van de Scheepvaartinspectie voorzover het de certificaten op grond van de Schepenwet betreft, en het Hoofd van de Scheepvaartinspectie in het Land Curaçao voorzover het de certificaten op grond van de bovengenoemde landsverordeningen betreft.
Het besluit treedt, evenals de overeenkomsten, in werking met ingang van 1 januari 2013.

Agreement of 13 June 2012 between the Administration of the Country of Curaçao / the Kingdom of the Netherlands and ....... hereafter referred to as RO, governing the authorization of statutory survey and certification services of ships registered in Curaçao, flying the flag of the Kingdom of the Netherlands and classed by RO and to which the international conventions are applicable.
1.1 RO is hereby authorized to carry out statutory survey, verification and certification services on behalf of the Administration as mentioned hereafter with respect to ships registered in Curaçao and classed by RO, in accordance with the International Conventions adopted by the Administration, the EU legislation as far as applicable and the Netherlands’ Acts, Orders, Ministerial Decrees, policy rules, regulations and instructions, also published on the ILT website, on conditions as specified in the Agreement.
The certification service is limited to the issue of interim statutory certificates, including the issue of short term certificates as required in ISM and ISPS codes.
The Administration will carry out the following surveys:
• the measurement of ships which are not classed by RO
• the additional surveys (see Appendix)
• the surveys of ships carrying INF in compliance with IMO Resolution MSC. 88(71) as amended, Class INF 3 ships and for Class INF 1 and 2 the items covered by Ch 8 Radiological protection and Ch 9 Management and training. Ch 10 Shipboard emergency plan will be performed by the Administration and the RO.
The RO is authorised to carry out all other surveys, audits and verifications as further specified in Appendix to this Annex.
With respect to the audits and verifications in accordance with the ISM or ISPS Codes the authorization is not limited to ships classed by RO/RSO or companies operating ships classed by RO.
The Administration will issue all full term certificates.
The RO is authorised to issue the interim certificates with exception of:
• the Safe Manning Document and all other documents in relation to manning;
• the registry documents such as the Certificate of Registry (Zeebrief);
• the Continuous Synopsis Record;
• the Statement of Compliance in accordance with the Condition Assessment Scheme;
• the Permit in accordance with article 2 bis of the Netherlands Ship’s Act;
• the Civil Liability Certificate;
• the Permit to Operate High Speed Craft;
• the Permit to Operate Dynamically supported craft;
• Specific National Declarations, e.g. Declaration of Port of Operation, Declaration for a single voyage outside the restricted area and Declaration for Manned Operations.
• All exemptions in relation to the issued certificates by the Administration.
With respect to the certification in accordance with the ISM or ISPS Codes the authorization is not limited to ships classed by RO/RSO or companies operating ships classed by RO.
The issue of the interim certificates by RO is on behalf of the Government of Curaçao. Delegated functions performed by and certificates issued by RO will be accepted ‘as performed’ by the Administration. This is the principle of ‘acting on behalf’ by mandate.
As prescribed by the ‘Joint Decision of the Inspector General, Head of the Shipping Inspectorate and the Head of the Shipping Inspectorate in Curaçao authorizing Recognized Organizations with regard to the certification of ships registered in Curaçao’, the Administration will provide a ‘standard’ letter to accompany the issue of certificates and to fulfil the obligations regarding national public law.
As stated in article 8.9 of the Agreement the appeals have to be dealt with by the Administration. The purpose of this ‘standard’ letter is also to clarify to the addressee to whom he or she can lodge an appeal in case of objections against the issue or non-issue of the certificate.
It’s the responsibility of RO to let the certificate be accompanied by the proper standard letter.
A valid Certificate of Registry (Zeebrief) is mandatory at the time the certificates are issued.
Certificates required in compliance with an international convention or a code, shall be issued in a format specified in that convention or code.
• The ship’s IMO number shall be entered in all certificates
• The text of all certificates shall be in the English language.
• The interim certificates are issued ‘ under the authority of the Government of Curaçao’
• The tonnage figure in all certificates shall be the GT as stated in the 1969 Tonnage Convention. However, for ships of which the keel has been laid prior to 18 July 1994, the GRT in accordance with 1948 Tonnage Measurement Convention may be used, with exception of the ISSC and SMC. In such cases the following footnote shall be printed in the certificate:
‘In compliance with Res. A. 791(19) the above mentioned gross tonnage has been measured by the Administration in accordance with the national tonnage rules which were in force prior to the entering into force of the International Convention on Tonnage Measurements 1969’.
Cargo and passenger ships, to which the international conventions are applicable, are to be surveyed in accordance with HSSC Protocol 1988, as further detailed in Res. A.1053(27), as amended.
Special attention is required for inspection of the outside of the passenger ships’ bottom. These surveys must be in compliance with article 5.10 of Resolution A.1053(27), as amended.
With regards to the ‘restore date’ of a certificate it is emphasized that in case a required survey has not been carried out or has been completed outside the ‘window’, an additional survey is mandatory. The scope and the depth of the survey is to be decided by the Administration.
After this survey has been carried out to the satisfaction of the Administration or RO, the certificate shall be provided with the following note:
‘at the request of the Curaçao Administration an additional survey has been carried out, after which the validity of this certificate has been restored’.
Essentially the statutory full term certificates issued in compliance with the international conventions will be recognized.
At the time of transfer RO shall survey the ship to confirm that the condition of the ship, its equipment and procedures (ISM and security) are in compliance with the specifications of the certificates and whether issued exemptions are in accordance with the Curaçao applicable instruments. If serious deviations are found, RO shall contact the Administration for further instructions.
Plans and documents, which in accordance with the conventions need to be approved by the Administration, shall be clearly marked ‘On behalf of the Administration’ by the RO.
Issue of certificates: see 2.2. and appendix.
RO is authorized to assess and approve all plans, and other documentation, such as but not limited to Cargo Securing Manuals, P & A manuals, COW manuals and SOPEP, required in the process to certification in compliance with the applicable instruments.
In case international conventions require plans or documentation to be approved by the Administration, the RO shall clearly mark that such plans or documentation are approved on behalf of this Administration.
2.4.4.1 Existing ships without RO notation for unattended engine rooms but with a valid document for unattended engine room in accordance with the requirements of the Netherlands or Curaçao Administration shall be accepted to continue to sail with unattended engine room notation without the obligation to fully comply with the relevant RO’s rules. The condition of the installation shall be surveyed by RO at the required periodical surveys in accordance with the relevant Administration requirements.
2.4.4.2 In order to execute 2.4.4.1 in an efficient and proper way the Administration is obliged to submit all information to RO. Relevant ships are mentioned on the website. Reports should be on board and are also available at the Administration.
2.4.4.3 RO may refuse to act in accordance with 2.4.4.1 when in the opinion of RO the information, the condition of the ship or installation is not satisfactory. The Admini-stration shall be informed accordingly.
RO is authorized to survey lifting gear and cargo gear in compliance with ILO 152.
Periodical surveys of combination cranes (stores and lifesaving appliances) are carried out by RO.
The design, construction and the maintenance shall comply with the rules of RO or the international standard ISO 8383 and EN 81-1 and 2 (1998) for elevators and the EN 115 (1998) for escalators.
In addition to RO also the Liftinstituut is authorized to perform surveys of elevators and escalators.
According to SOLAS Chapter V, regulation 18.8 voyage data recorder systems shall be subject to an annual performance test. The test shall be conducted by a testing or servicing facility authorized (approved) by the manufacturer of the voyage data recorder systems.
In connection with surveys in relation to the Safety Certificate the RO shall verify the existence of a valid certificate of compliance issued by the testing facility, stating the date of compliance and the applicable performance standards.
A station servicing inflatable liferafts should be approved in accordance with IMO Resolution A.761(18). The Administration has decided to implement the resolution as follows:
• the service station shall be approved by the manufacturer of the inflatable liferafts in question and by or on behalf of the national maritime administration in the country where the service station has its premises. Separate approval by RO is not required.
• in Curaçao the Administration has approved service stations (see web site).
If the RO is able to provide objective evidence of major non-conformities in the service work performed on inflatable liferafts this shall be reported to the manufacturer of the inflatable liferaft and to the Administration.
The authorization stated in par.4.1 of the Agreement includes the authorization to extend the service period of inflatable liferafts and hydrostatic release units as specified in SOLAS, Chapter III, Regulation 20.8.1.1 and Regulation 20.9.1 for ships for which the RO performs surveys for the Safety Certificate. The service period must not be extended automatically but only after a well-founded request, and it must not be extended beyond the period specified in the above regulations.
When performing surveys on Curaçao ships leading to the issuance of statutory certificates the RO shall assess whether the equipment is type approved in accordance with the regulations stipulated in the conventions or national regulations.
Type approval is also required for equipment as meant in SOLAS V/18/7.
Equipment bearing the EC wheel mark or is type approved in accordance with the MRA (Mutual Recognition Agreement) is considered to be type approved by the Curaçao and is acceptable.
Equipment not bearing an EC wheel mark or MRA mark but approved by the Netherlands Shipping Inspectorate, a Maritime Administration of an EC/EEA country, the USCG or RO in accordance with international accepted standards, is acceptable. A copy of the type approval certificate shall accompany the equipment.
In case of replacement of equipment and if equipment with the aforementioned characteristics is not available the RO shall consult the Administration for advice.
Halon fire extinguishing systems are not allowed on Curaçao ships. RO is requested to inform the Administration if Halon is found on board.
