Regeling van de Staatssecretaris van Volkshuisvesting, Ruimtelijke Ordening en Milieubeheer en de Staatssecretaris van Sociale Zaken en Werkgelegenheid van 18 februari 2004, Nr. SAS/2004011401 inzake de eisen aan de uitvoering van het kwaliteitsmanagement bij kerncentrales (Regeling kwaliteitsborging van kerncentrales)
De Staatssecretaris van Volkshuisvesting, Ruimtelijke Ordening en Milieubeheer, en de Staatssecretaris van Sociale Zaken en Werkgelegenheid,
Gelet op artikel 20 van het Besluit kerninstallaties, splijtstoffen en ertsen;
Besluiten:
Inrichtingen als bedoeld in artikel 15, onder b, van de Kernenergiewet, waarin kernenergie kan worden vrijgemaakt met het oogmerk om energie op te wekken, voldoen aan de Code and Safety Guides Q1 tot en met Q7 en Q10 tot en met Q14, Quality Assurance for Safety in Nuclear Power Plants and other Nuclear Installations, uitgave 1996, van het International Atomic Energy Agency te Wenen, zoals gewijzigd overeenkomstig de bijlage bij deze regeling.
Deze regeling wordt aangehaald als: Regeling kwaliteitsborging van kerncentrales.
Deze regeling treedt in werking met ingang van de tweede dag na de dagtekening van de Staatscourant waarin zij wordt geplaatst.
Deze regeling zal met de toelichting in de Staatscourant worden geplaatst.

NVR 1.3. Hoofdregel kwaliteitsborging (IAEA C Q: Code on QA etc.)
Sectie 102: Code vs. Safety Guides:

The guidance given in the NVR’s 2.3.1-14. shall be followed by the licensee, unless the licensee is able to justify that the methods and solutions the licensee wants to implement give at least the same level of safety and quality, or if the licensee is able to justify that the specific guidance is not applicable or possible for their installation or specific situation.

NVR 2.3.14 (IAEA SG Q14): QA in decommissioning

In 1989 kwamen onder verantwoordelijkheid van de Ministeries van Sociale Zaken en Werkgelegenheid en van Volkshuisvesting, Ruimtelijke Ordening en Milieubeheer drie overkoepelende Nucleaire Veiligheidsregels (NVR’s) tot stand (Stcrt. 27-11-1989, nr. 169). De NVR’s betroffen de drie onderwerpen ontwerp, bedrijfsvoering en kwaliteitsborging van kerncentrales. In 1991 werden de onderliggende richtlijnen inzake bedrijfsvoering en kwaliteitsborging vastgesteld (Stcrt. 31-7-1991, nr. 146) en in 1999 die inzake het ontwerp van kerncentrales (Stcrt.19-2-1999, nr. 35). De NVR’s – zowel de regels als de richtlijnen – zijn ontwikkeld uit overeenkomstige door het Internationaal Atoomenergie-agentschap (IAEA) te Wenen opgestelde Codes en Safety Guides.
Thans zijn de NVR’s inzake de kwaliteitsborging opnieuw vastgesteld bij ministeriële regeling van de Staatssecretarissen van Volkshuisvesting, Ruimtelijke Ordening en Milieubeheer en van Sociale Zaken en Werkgelegenheid. Aanleiding hiertoe vormt de in 1996 door het IAEA uitgegeven geheel herziene serie kwaliteitsregels en richtlijnen (de zgn. Q-serie) in het kader van het Nucleaire Safety Series programma. Deze herziene Q-serie, waaraan zowel de industrie als de toezichthoudende overheden hebben meegewerkt, is gericht op de beschrijving van de uitvoering van het kwaliteitsmanagement bij kerncentrales. Voor de Nederlandse situatie is deze serie, met uitzondering van richtlijnen 8 en 9, omgezet in de Nucleaire Veiligheidsregels en -Richtlijnen NVR 1.3 en 2.3.1 tot en met NVR 2.3.14. Deze vervangen de eerder in 1991 vastgestelde NVR’s 1.3 en 2.3.1 tot en met NVR 2.3.11. De onderwerpen ‘Research and Development’ en ‘Siting’ (nrs. 8 en 9) zijn net als in 1991 niet opgenomen, omdat het geen overheidstaak betreft respectievelijk alleen relevant is voor nieuw te bouwen centrales.
Zoals aangegeven zijn de herziene NVR’s net als de voorgaande Q-serie in beginsel opgezet voor kerncentrales, maar in voorkomende gevallen kunnen ze ook worden toegepast op grotere researchreactoren zoals de Hoge Flux Reactor te Petten.
De onderhavige regeling is gebaseerd op artikel 20 van het Besluit kerninstallaties, splijtstoffen en ertsen. In de bijlage bij de regeling zijn de vastgestelde NVR’s en de daarbij geregelde onderwerpen opgenomen alsmede de corresponderende IAEA-regels waarop de NVR’s gebaseerd zijn. Een NVR is een voor de Nederlandse situatie aangepaste IAEA Code of Safety Guide en bestaat praktisch uit deze IAEA-regels en de daarop geschreven amendering.
De IAEA Code en Safety Guides zijn van oorsprong Engelstalige teksten. Aangezien het hier om zeer specifieke normen gaat, gericht tot een sterk gespecialiseerde groep normadressaten, is in het onderhavige kader geen vertaling naar het Nederlands nodig.
De IAEA Code en Safety Guides worden niet gepubliceerd vanwege hun omvang en het feit dat hun kenbaarheid voldoende verzekerd is. Wel worden zij ter inzage gelegd bij de Kernfysische Dienst van het Ministerie van Volkshuisvesting, Ruimtelijke Ordening en Milieubeheer.
Het toepassen van ‘shall’ in plaats van ‘should’ bij de Safety Guides is kritisch bekeken, maar is veelal niet veranderd, mede omdat via de amendering op sectie 102 van de Code duidelijkheid met actie van de kant van de vergunninghouder geïntroduceerd is. Waar in de IAEA documenten sprake is van ‘Requirements’ of ‘Code’ dan wel ‘(Safety) Guides’ moet gelezen worden de desbetreffende ‘NVR’.
In het onderstaande overzicht wordt van de vastgestelde NVR's de corresponderende IAEA-regel vermeld waarop de NVR gebaseerd is, of – waar geen wijziging nodig is – waaraan de NVR gelijk is.

Reden: Bij de nieuwe Q-tekst is de rol van de overheid vrijwel buiten nadere beschouwing gebleven. Ook hier geldt dat de IAEA Q-series de basis vormt voor het formele nucleaire toezicht. Daarnaast moeten postbusorganisaties vermeden worden.
