Bij Resolutie MSC.154(78) heeft de Maritieme Veiligheidscommissie van de Internationale Maritieme Organisatie op 20 mei 2004 in overeenstemming met artikel VI van het Protocol juncto artikel VIIIb)iv) van het Verdrag wijzigingen aangenomen. Adoption of Amendments to the Protocol of 1988 relating to the International Convention for the Safety of Life at Sea, 1974
The Maritime Safety Committee,
Recalling Article 28b) of the Convention on the International Maritime Organization concerning the functions of the Committee,
Recalling further article VIIIb) of the International Convention for the Safety of Life at Sea (SOLAS), 1974 (hereinafter referred to as “the Convention”) and article VI of the Protocol of 1988 relating to the Convention (hereinafter referred to as “the 1988 SOLAS Protocol”) concerning the procedure for amending the 1988 SOLAS Protocol,
Having considered, at its seventy-eighth session, amendments to the 1988 SOLAS Protocol proposed and circulated in accordance with article VIII(b)(i) of the Convention and article VI of the 1988 SOLAS Protocol,
1. Adopts, in accordance with article VIIIb)iv) of the Convention and article VI of the 1988 SOLAS Protocol, amendments to the appendix to the Annex to the 1988 SOLAS Protocol, the text of which is set out in the Annex to the present resolution;
2. Determines, in accordance with article VIIIb)vi)2bb) of the Convention and article VI of the 1988 SOLAS Protocol, that the said amendments shall be deemed to have been accepted on 1 January 2006 unless, prior to that date, more than one third of the Parties to the 1988 SOLAS Protocol or Parties the combined merchant fleets of which constitute not less than 50% of the gross tonnage of the world’s merchant fleet, have notified their objections to the amendments;
3. Invites the Parties concerned to note that, in accordance with article VIIIb)vii)2 of the Convention and article VI of the 1988 SOLAS Protocol, the amendments shall enter into force on 1 July 2006 upon their acceptance in accordance with paragraph 2 above;
4. Requests the Secretary-General, in conformity with article VIIIb)v) of the Convention and article VI of the 1988 SOLAS Protocol, to transmit certified copies of the present resolution and the text of the amendments contained in the Annex to all Parties to the 1988 SOLAS Protocol;
5. Further requests the Secretary-General to transmit copies of this resolution and its Annex to Members of the Organization, which are not Parties to the 1988 SOLAS Protocol.

The Maritime Safety Committee,
Recalling Article 28b) of the Convention on the International Maritime Organization concerning the functions of the Committee,
Recalling also article VIIIb) of the International Convention for the Safety of Life at Sea, 1974 (hereinafter referred to as “the Convention”) and article VI of the Protocol of 1988 relating to the Convention (hereinafter referred to as “the 1988 SOLAS Protocol”) concerning the procedure for amending the Convention and the 1988 SOLAS Protocol,
Recalling further article VIb) of the 1988 SOLAS Protocol which stipulates, inter alia, that amendments to the Annex to the Protocol shall be adopted and brought into force in accordance with the procedure applicable to the adoption and entry into force of amendments to chapter I of the Annex to the Convention, as specified in subparagraphs iv), vi)1 and vii)1 of paragraph b) of article VIII of the Convention,
Noting that, in accordance with article VIIIb)vi)1 of the Convention, an amendment to the Annex to the 1988 SOLAS Protocol shall be deemed to have been accepted on the date on which it is accepted by two thirds of the Parties to the Protocol,
Having considered, at its eighty-first session, amendments to the 1988 SOLAS Protocol proposed and circulated in accordance with article VIIIb)i) of the Convention and article VIb) of the 1988 SOLAS Protocol,
1. Adopts, in accordance with article VIIIb)iv) of the Convention and article VIb) of the 1988 SOLAS Protocol, amendments to the Annex to the 1988 SOLAS Protocol, the text of which is set out in the Annex to the present resolution;
2. Requests the Secretary-General, in accordance with article VIIIb)v) of the Convention and article VIb) of the 1988 SOLAS Protocol, to transmit certified copies of the present resolution and its Annex to all Parties to the 1988 SOLAS Protocol, for consideration and acceptance, and also to transmit copies to all Members of the Organization;
3. Urges all Parties to the 1988 SOLAS Protocol to accept the amendments at the earliest possible date.
The existing text of subparagraph v) of paragraph a) of the regulation is replaced by the following:
“v) a minimum of two inspections of the outside of the ship’s bottom during the five-year period of validity of the Cargo Ship Safety Construction Certificate or the Cargo Ship Safety Certificate, except where regulation 14e) or 14f) is applicable. Where regulation 14e) or 14f) is applicable, this five-year period may be extended to coincide with the extended period of validity of the certificate. In all cases the interval between any two such inspections shall not exceed 36 months;”.

1. The following new paragraphs 2.10 and 2.11 are added after the existing paragraph 2.9 in the section commencing with the words “THIS IS TO CERTIFY”:
“2.10 the ship was/was not/1) subjected to an alternative design and arrangements in pursuance of regulation II-2/17 of the Convention;
2.11 a Document of approval of alternative design and arrangements for fire safety is/is not/1) appended to this Certificate.

2. In the table of paragraph 2.1.3 in the section commencing with the words “THIS IS TO CERTIFY”, the reference to “regulation II-1/13” is replaced by the reference to “regulation II-1/184)”, the words “C.1, C.2, C.3” are replaced by “P.1, P.2, P.3” and the following footnote is added:
“4) For ships constructed before 1 January 2009, the applicable subdivision notation “C.1, C.2 and C.3” should be used.”

De wijzigingen zijn in overeenstemming met artikel VI van het Protocol juncto artikel VIIIb)vii)2 van het Verdrag op 1 juli 2006 in werking getreden.
Wat het Koninkrijk der Nederlanden betreft, gelden de wijzigingen voor het gehele Koninkrijk.

De wijzigingen zijn in overeenstemming met artikel VI van het Protocol juncto artikel VIIIb)vii)2 van het Verdrag op 1 juli 2006 in werking getreden.
Wat het Koninkrijk der Nederlanden betreft, gelden de wijzigingen voor het gehele Koninkrijk.

De wijzigingen zullen ingevolge artikel VI van het Protocol juncto artikel VIIIb)vii)1 van het Verdrag in werking treden, zes maanden na de datum waarop zij overeenkomstig artikel VIIIb)vi)1 van het Verdrag zijn aanvaard door twee derde van de Verdragsluitende Regeringen.

De wijzigingen zullen ingevolge artikel VI van het Protocol juncto artikel VIIIb)vii)2 van het Verdrag op 1 juli 2009 in werking treden, tenzij overeenkomstig artikel VIIIb)vi)2 vóór 1 januari 2009 meer dan een derde van de Verdragsluitende Regeringen, hetzij Verdragsluitende Regeringen waarvan de gezamenlijke koopvaardijvloten niet minder dan vijftig procent van de bruto tonnage van de wereldkoopvaardijvloot vormen, de Secretaris-Generaal van de Internationale Maritieme Organisatie ervan in kennis stellen, dat zij bezwaar hebben tegen de wijzigingen.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat de wijzigingen van het Protocol zullen zijn bekendgemaakt in Nederland, de Nederlandse Antillen en Aruba op de dag na de datum van uitgifte van dit Tractatenblad.
