BRIEF VAN DE MINISTER VAN JUSTITIE

Aan de Voorzitter van de Eerste Kamer der Staten-Generaal

Tijdens de plenaire behandeling van het wetsvoorstel tot goedkeuring van het Verdrag van Amsterdam in uw Kamer is toegezegd u bij de indiening in uw Kamer van het voorstel van een Wet bescherming persoonsgegevens een overzicht te doen toekomen waarin de stand van zaken wordt weergegeven van de implementatie van de Europese privacyrichtlijn in de diverse lidstaten van de Europese Unie. Bijgaand treft u dit overzicht aan.

Status of implementation of Directive 95/46

BelgiumThe implementation law was passed by the Parliament and published on the Official Journal of 3 February 1999. 
DenmarkPartial implementation by a law amending the Civil Registration Act which came into force on October 1, 1998. A bill has been introduced to Parliament twice.Introduction of the third bill when Parliament resumes in October 1999.
GermanyParliament work yet to start. Legislation will be needed at the Laender level as well.Bill to be dealt with by Parliament in October 1999.
SpainA Bill was adopted by the Government in July. It consists of minor changes to the existing «Ley Organica». The Bill was passed by the first Chamber and is being examined by the Senate.Vote of the Senate.

GreeceImplementation Law 2472 adopted on 10.4.1997 
ItalyLaw 675 of 31.12.1996 completed by secondary legislation. 
IrelandDraft bill presented to Government in July 1998.Bill to be approved by Government and submitted to Parliament.
LuxembourgThe ministry of justice is finalising the bill.The bill was to be presented to the Parliament in March.
The NetherlandsDraft bill presented to the Second Chamber on 16.2.1998.Parliamentary adoption (Second and First Chamber). Plenary discussion took place on 15 March 1999.
AustriaThe Directive has been implemented by the Data Protection Act 2000 to enter into force on January 1., 2000. 
PortugalThe Directive has been implemented by Law 67/98 of 26 October 1998. 
SwedenSFS 1998: 204 of 29.4.98 and regulation SFS 1998: 1191 of 3.9.98, all of which came into force on October 25.1998. 
FinlandThe Law was enacted by the Finnish Parliament on 10 February 1999 and entered into force June 1., 1999. 
United KingdomThe Data Protection Act 1998 received Royal Assent on 16 July 1998Secondary legislation to be adopted before March, 1., 2000.
