Bij beschikking van 7 december 2021 heeft het college besloten om de volgende bomen aan te wijzen als waardevolle boom.

De aanwijzing van waardevolle bomen is geregeld in artikel 11 van de Bomenverordening Geldrop-Mierlo 2019. Een nadere uitwerking hiervan is opgenomen in de module Bescherming van het Groenbeleidsplan 2014-2024.

Waardevolle bomen genieten extra bescherming; er is bijvoorbeeld een omgevingsvergunning nodig om deze te mogen kappen.

Met ingang van vrijdag 7 januari 2022 liggen de boomrapporten waarop deze bomen beschreven zijn (inclusief motivering voor de aanwijzing) gedurende zes weken ter inzage in de publiekshal van het gemeentehuis, De Meent 2 in Geldrop. De publiekshal is geopend van maandag tot en met donderdag van 9.00-17.00 uur en op vrijdag van 9.00-12.30 uur. Op deze locatie zijn voorzieningen getroffen in het kader van het weren van het Corona-virus.

Bezwaar

Bent u belanghebbende en bent u het niet eens met deze beslissing? Dan kunt u ingevolge de Algemene wet bestuursrecht vanaf 7 januari 2022 gedurende 6 weken bezwaar bij ons aantekenen. Het bezwaarschrift bevat ten minste uw naam en adres, de datum waarop u het bezwaarschrift heeft geschreven, een omschrijving van het besluit waartegen het bezwaar zich richt en de gronden van het bezwaar. Daarnaast dient het bezwaarschrift door u te zijn ondertekend.

Uw bezwaarschrift kunt u per post aan het college burgemeester en wethouders van Geldrop-Mierlo richten. Het postadres is postbus 10101, 5660 GA Geldrop. U kunt er ook voor kiezen om uw bezwaarschrift digitaal in te dienen via https://www.geldrop-mierlo.nl/bezwaar-maken/. Hiervoor moet u beschikken over een elektronische handtekening (DigiD voor particulieren / E-Herkenning voor bedrijven).

Voorlopige voorziening

Een ingediend bezwaar schorst niet de werking van het besluit. Als u denkt dat dit nodig is, dan kunt u een verzoek om voorlopige voorziening indienen bij de voorzieningenrechter van de Rechtbank Oost-Brabant (sector bestuursrecht, Postbus 90125, 5200 MA ’s-Hertogenbosch). Aan het indienen van een dergelijk verzoek zijn kosten verbonden.

Een verzoekschrift tot het treffen van een voorlopige voorziening kan ook digitaal bij genoemde rechtbank via https://mijn.rechtspraak.nl/keuze worden ingediend. Daarvoor moet u eveneens beschikken over een digitale handtekening. Kijk op de genoemde site voor de precieze voorwaarden.
