Wijziging van 27 februari 1998 bij besluit IV/9

Tijdens de vierde vergadering van de Conferentie van Verdragsluitende Partijen op 27 februari 1998 is bij besluit IV/9 een wijziging van Bijlage 1 bij het Verdrag voorgesteld en twee nieuwe Bijlagen, respectievelijk VIII en IX aangenomen. De Engelse en de Franse tekst¹ van de wijziging en de bijlagen luiden als volgt:

IV/9. Amendment and adoption of annexes to the Convention

The Conference,

Recalling decision III/1 of the Conference of the Parties, which instructed the Technical Working Group, among other things, to give full priority to completing the work on hazard characterization and the development of lists, in order to submit them for approval to the fourth meeting of the Conference of the Parties,

Recalling decision III/12 of the Conference of the Parties, which instructed the Technical Working Group, among other things, to consider ways of taking forward the development of lists of hazardous wastes and the applicable procedure for their review based on the outcome of the work of the Technical Working Group, as well as further developing lists of wastes not covered by this Convention,

Taking note of the work carried out by the Technical Working Group and in particular the development of a list of wastes that are characterized as hazardous pursuant to Article 1, paragraph 1 (a), (list A contained in the note on consolidated lists of wastes and the applicable procedures for their review and adjustment (UNEP/CHW.4/3)) and a list of wastes that are not covered by article 1, paragraph 1 (a), of this Convention (list B contained in the note on consolidated lists of wastes and the applicable procedures for their review and adjustment), as well as the progress made in the development of a procedure for reviewing or adjusting these lists and of an application form required for the placement or removal of wastes on these lists,

Considering that Annex I and Annex III shall remain the factors to characterize wastes as hazardous for the purpose of this Convention, that lists A and B developed by the Technical Working Group provide an expeditious way to facilitate the implementation of this Convention, including Article 4A, by establishing wastes that are and wastes that are not covered by Article 1, paragraph 1 (a), of this Convention, and that these lists should have equal status,

Noting that wastes listed in lists A and B are an elaboration and clarification of the provisions of Article 1, paragraph 1 (a), of this Convention by reference to Annexes I and III,

Recognizing that List A and List B are not intended to be exhaustive,

Taking note that the Open-ended Ad Hoc Committee decided at its third meeting to propose that the Conference of the Parties extend the mandate of the Technical Working Group to take charge of the procedure for reviewing or adjusting the lists of wastes and that the Conference of the Parties adopt the application form for this purpose, as set out in the note on consolidated lists of wastes and the applicable procedures for their review and adjustment,

Taking note that, pursuant to decision IV/6, the Technical Working Group is instructed to keep the lists of wastes under review and to make recommendations to the Conference of the Parties for revisions or adjustments,

Further taking note that, pursuant to decision IV/6, the Technical Working Group is instructed to review the procedure for reviewing or adjusting the lists of wastes, including the Application Form as set out in the note on consolidated lists of wastes and the applicable procedures for their review and adjustment and to submit a proposal for approval at the fifth meeting of the Conference of the Parties,

Decides to adopt the following amendment and adoption of annexes to this Convention:

1. Add the following paragraphs at the end of Annex I:

• a) To facilitate the application of this Convention, and subject to paragraphs b), c) en d), wastes listed in Annex VIII are characterized as hazardous pursuant to Article 1, paragraph 1 (a), of this Convention, and wastes listed in Annex IX are not covered by Article 1, paragraph 1 (a), of this Convention.

• b) Designation of a waste on Annex VIII does not preclude, in a particular case, the use of Annex III to demonstrate that a waste is not hazardous pursuant to Article 1, paragraph 1 (a), of this Convention.

• c) Designation of a waste on Annex IX does not preclude, in a particular case, characterization of such a waste as hazardous pursuant to Article 1, paragraph 1 (a), of this Convention if it contains Annex I material to an extent causing it to exhibit an Annex III characteristic.

• d) Annexes VIII and IX do not effect the application of Article 1, paragraph 1 (a), of this Convention for the purpose of characterization of wastes.

2. Add the following two new annexes to the Convention as its Annexes VIII and IX.

Annex VIII

List A

Wastes contained in this Annex are characterized as hazardous under Article 1, paragraph 1 (a), of this Convention, and their designation on this Annex does not preclude the use of Annex III to demonstrate that a waste is not hazardous.

A1 Metal and metal-bearing wastes

A1010 Metal wastes and waste consisting of alloys of any of the following: • Antimony

• Arsenic

• Beryllium

• Cadmium

• Lead

• Mercury

• Selenium

• Tellurium

• Thallium

but excluding such wastes specifically listed on list B.

A1020 Waste having as constituents or contaminants, excluding metal waste in massive form, any of the following:

• Antimony; antimony compounds

• Beryllium; beryllium compounds

• Cadmium; cadmium compounds

• Lead; lead compounds

• Selenium; selenium compounds

• Tellurium; tellurium compounds

A1030 Wastes having as constituents or contaminants any of the following:

• Arsenic; arsenic compounds

• Mercury; mercury compounds

• Thallium; thallium compounds

A1040 Wastes having as constituents any of the following:

• Metal carbonyls

• Hexavalent chromium compounds

A1050 Galvanic sludges

A1060 Waste liquors from the pickling of metals

A1070 Leaching residues from zinc processing, dust and sludges such as jarosite, hematite, etc.

A1080 Waste zinc residues not included on list B, containing lead and cadmium in concentrations sufficient to exhibit Annex III characteristics

A1090 Ashes from the incineration of insulated copper wire

A1100 Dusts and residues from gas cleaning systems of copper smelters

A1110 Spent electrolytic solutions from copper electrorefining and electrowinning operations

A1120 Waste sludges, excluding anode slimes, from electrolyte purification systems in copper electrorefining and electrowinning operations

A1130 Spent etching solutions containing dissolved copper

A1140 Waste cupric chloride and copper cyanide catalysts

A1150 Precious metal ash from incineration of printed circuit boards not included on list B¹

A1160 Waste lead-acid batteries, whole or crushed

A1170 Unsorted waste batteries excluding mixtures of only list B batteries. Waste batteries not specified on list B containing Annex I constituents to an extent to render them hazardous.

A1180 Waste electrical and electronic assemblies or scrap² containing components such as accumulators and other batteries included on list A, mercury-switches, glass from cathode-ray tubes and other activated glass and PCB-capacitors, or contaminated with Annex I constituents (e.g., cadmium, mercury, lead, polychlorinated biphenyl) to an extent that they possess any of the characteristics contained in Annex III (note the related entry on list B B1110)³

A2 Wastes containing principally inorganic constituents, which may contain metals and organic materials

A2010 Glass waste from cathode-ray tubes and other activated glasses

A2020 Waste inorganic fluorine compounds in the form of liquids or sludges but excluding such wastes specified on list B

A2030 Waste catalysts but excluding such wastes specified on list B

A2040 Waste gypsum arising from chemical industry processes, when containing Annex I constituents to the extent that it exhibits an Annex III hazardous characteristic (note the related entry on list B B2080)

A2050 Waste asbestos (dusts and fibres)

A2060 Coal-fired power plant fly-ash containing Annex I substances in concentrations sufficient to exhibit Annex III characteristics (note the related entry on list B B2050)

A3 Wastes containing principally organic constituents, which may contain metals and inorganic materials

A3010 Waste from the production or processing of petroleum coke and bitumen

A3020 Waste mineral oils unfit for their originally intended use

A3180 Wastes, substances and articles containing, consisting of or contaminated with polychlorinated biphenyl (PCB), polychlorinated terphenyl (PCT), polychlorinated naphthalene (PCN) or polybrominated biphenyl (PBB), or any other polybrominated analogues of these compounds, at a concentration level of 50 mg/kg or more¹

A3190 Waste tarry residues (excluding asphalt cements) arising from refining, distillation and any pyrolitic treatment of organic materials

A4 Wastes which may contain either inorganic or organic constituents

A4010 Wastes from the production, preparation and use of pharmaceutical products but excluding such wastes specified on list B

A4020 Clinical and related wastes; that is wastes arising from medical, nursing, dental, veterinary, or similar practices, and wastes generated in hospitals or other facilities during the investigation or treatment of patients, or research projects

A4030 Wastes from the production, formulation and use of biocides and phytopharmaceuticals, including waste pesticides and herbicides which are off-specification, outdated,² or unfit for their originally intended use

A4040 Wastes from the manufacture, formulation and use of woodpreserving chemicals¹

A4050 Wastes that contain, consist of or are contaminated with any of the following:

• Inorganic cyanides, excepting precious-metal-bearing residues in solid form containing traces of inorganic cyanides

• Organic cyanides

A4060 Waste oils/water, hydrocarbons/water mixtures, emulsions

A4070 Wastes from the production, formulation and use of inks, dyes, pigments, paints, lacquers, varnish excluding any such waste specified on list B (note the related entry on list B B4010)

A4080 Wastes of an explosive nature (but exclusing such wastes specified on list B)

A4090 Waste acidic or basic solutions, other than those specified in the corresponding entry on list B (note the related entry on list B B2120)

A4100 Wastes from industrial pollution control devices for cleaning of industrial off-gases but excluding such wastes specified on list B

Wastes contained in the Annex will not be wastes covered by Article 1, paragraph 1 (a), of this Convention unless they contain Annex I material to an extent causing them to exhibit an Annex III characteristic.

• Precious metals (gold, silver, the platinum group, but not mercury)

B1070 Waste of copper and copper alloys in dispersible form, unless they contain Annex I constituents to an extent that they exhibit Annex III characteristics

B1080 Zinc ash and residues including zinc alloys residues in dispersible form unless containing Annex I constituents in concentration such as to exhibit Annex III characteristics or exhibiting hazard characteristic H4.3²

B1090 Waste batteries conforming to a specification, excluding those made with lead, cadmium or mercury

B1100 Metal-bearing wastes arising from melting, smelting and refining of metals:

• Hard zinc spelter

• Zinc-containing drosses:

– Galvanizing slab zinc top dross (>90% Zn)

– Galvanizing slab zinc bottom dross (>92% Zn)

B3020 Paper, paperboard and paper product wastes

The following materials, provided they are not mixed with hazardous wastes:

Waste and scrap of paper or paperboard of:

• unbleached paper or paperboard or of corrugated paper or paperboard

• other paper or paperboard, made mainly of bleached chemical pulp, not coloured in the mass

• paper or paperboard made mainly of mechanical pulp (for example, newspapers, journals and similar printed matter)

• other, including but not limited to 1) laminated paperboard 2) unsorted scrap.

B3030 Textile wastes

The following materials, provided they are not mixed with other wastes and are prepared to a specification:

• Silk waste (including cocoons unsuitable for reeling, yarn waste and garnetted stock)

– not carded or combed

– other

• Waste of wool or of fine or coarse animal hair, including yarn waste but excluding garnetted stock

– noils of wool or of fine animal hair

– other waste of wool or of fine animal hair

– waste of coarse animal hair

• Cotton waste (including yarn waste and garnetted stock)

– yarn waste (including thread waste)

– garnetted stock

– other

• Flax tow and waste

• Tow and waste (including yarn waste and garnetted stock) of true hemp (Cannabis sativaL.)

IV/9. Amendement et adoption des annexes à la Convention

La Conférence,

Rappelant la décision III/1 de la Conférence des Parties par laquelle il était donné pour instruction au Groupe de travail technique, entre autres, de considérer comme absolument prioritaire l'achèvement des travaux relatifs à la définition des caractéristiques de danger et à l'élaboration de listes, afin de soumettre les résultats de ces travaux à l'approbation de la Conférence des Parties à sa quatrième réunion,

Rappelant la décision III/12 de la troisième Conférence des Parties par laquelle le Groupe de travail technique était prié, entre autres, d'examiner les moyens de faire progresser l'élaboration de listes de déchets dangereux et la procédure à appliquer pour leur révision en fonction des conclusions du Groupe de travail technique, et d'étoffer les listes de déchets non visés par la Convention de Bâle,

Prenant note des travaux menés à bien par le Groupe de travail technique et en particulier de l'élaboration d'une liste de déchets considérés comme dangereux aux termes de l'alinéa a) du paragraphe 1 de l'article premier (liste A figurant dans la note sur les listes récapitulatives de déchets et la procédure de révision des listes (UNEP/CHW.4/3)) et d'une liste de déchets non visés à l'alinéa a) du paragraphe 1 a) de l'article premier de la Convention (liste B figurant dans la note sur les listes récapitulatives de déchets et la procédure de révision des listes), ainsi que des progrès faits en ce qui concerne l'élaboration d'une procédure de révision et d'ajustement de ces listes et d'un formulaire de demande d'inscription de déchets sur lesdites listes ou de radiation des déchets,

Considérant que les caractéristiques énoncées aux annexes I et III doivent demeurer les caractéristiques définissant la dangerosité des déchets aux fins de la Convention de Bâle, que les listes A et B mises au point par le Groupe de travail technique permettent de disposer d'une procédure rapide permettant de faciliter l'application de la Convention et notamment de l'article 4A, en indiquant les déchets qui sont visés à l'alinéa a) du paragraphe 1 de l'article premier de la Convention et ceux qui ne le sont pas, et que ces listes devraient revêtir la même importance,

Notant que les listes A et B de déchets développent et précisent les dispositions de l'alinéa a) du paragraphe 1 de l'article premier de la Convention, compte tenu des annexes I et III,

Notant que les listes A et B ne sont pas exhaustives,

Prenant note du fait que le Comité spécial à composition non limitée a décidé à sa troisième réunion de proposer à la Conférence des Parties d'élargir le mandat du Groupe de travail technique afin qu'il se charge de la procédure de révision et d'ajustement des listes de déchets et d'adopter le formulaire de demande à cette fin, comme cela est indiqué dans la note sur les listes récapitulatives de déchets et la procédure de révision des listes,

Prenant note du fait que, conformément à la décision IV/6, le Groupe de travail technique est chargé de garder les listes de déchets à l'étude et de faire des recommandations à la Conférence des Parties concernant leur révision et leur ajustement,

Prenant également note du fait que, conformément à la décision IV/6, le Groupe de travail technique est chargé d'examiner la procédure de révision et d'ajustement des listes de déchets, y compris le formulaire de demande d'inscription ou de radiation, qui figure dans la note sur les listes, récapitulatives de déchets et la procédure de révision des listes, et de soumettre une proposition aux fins d'approbation à la cinquième réunion de la Conférence des Parties,

Décide d'adopter l'amendement à la Convention et les annexes ci-après:

1. Ajouter les paragraphes suivants à la fin de l'annexe I ci-après:

• a) Pour faciliter l'application de la Convention et sour réserve des alinéas b), c) et d), les déchets énumérés dans l'annexe VIII sont considérés comme dangereux aux termes de l'alinéa a) du paragraphe 1 de l'article premier de la Convention et les déchets énumérés dans l'annexe IX ne sont pas visés à l'alinéa a) du paragraphe 1 de l'article premier de la Convention.

• b) L'inscription d'un déchet à l'annexe VIII n'exclut pas que dans certains cas l'on recoure à l'annexe III pour démontrer qu'un déchet n'est pas dangereux aux termes de l'alinéa a) du paragraphe 1 de l'article premier de la Convention.

• c) L'inscription d'un déchet à l'annexe IX n'exclut pas que dans certains cas l'on considère un déchet comme dangereux aux termes de l'alinéa a) du paragraphe 1 de l'article premier de la Convention si ledit déchet contient une matière inscrite à l'annexe I en quantité suffisante pour présenter une caractéristique de danger de l'annexe III.

• d) Les annexes VIII en IX sont sans incidence sur l'application de l'alinéa a) du paragraphe 1 de l'article premier de la Convention aux fins de la caractérisation des déchets.

2. Ajouter à la Convention les annexes VIII et IX ci-après.

IV/9. Wijziging en aanneming van bijlagen bij het Verdrag

De Conferentie,

In herinnering roepend beslissing III/1 van de Conferentie der Partijen, waarbij aan de Technische Werkgroep de opdracht is gegeven om, onder meer, absolute prioriteit te geven aan het afmaken van de werkzaamheden met betrekking tot de definiëring van de gevaarlijke eigenschappen en de opstelling van lijsten, teneinde de resultaten van deze werkzaamheden ter goedkeuring voor te leggen aan de vierde vergadering van de Conferentie der Partijen;

In herinnering roepend beslissing III/12 van de Conferentie der Partijen, waarbij de Technische Werkgroep is verzocht om, onder meer, te bestuderen op welke wijze de opstelling van lijsten van gevaarlijke afvalstoffen kan worden bevorderd en welke procedure moet worden gevolgd voor de herziening hiervan, afhankelijk van de resultaten van het werk van de Technische Werkgroep, en de lijsten met gevaarlijke afvalstoffen waarop dit Verdrag niet van toepassing is, uit te breiden;

Gelet op de door de Technische Werkgroep gerealiseerde werkzaamheden, met name de opstelling van een lijst met afvalstoffen die ingevolge artikel 1, eerste lid, onder a (Lijst A opgenomen in de nota inzake de overzichtslijsten van afvalstoffen en de toepasselijke procedure voor de herziening en aanpassing hiervan (UNEP/CHW.4/3)) als gevaarlijk worden beschouwd en van een lijst van afvalstoffen waarop artikel 1, eerste lid, onder a, van dit Verdrag niet van toepassing is (Lijst B opgenomen in de nota inzake de overzichtslijsten van afvalstoffen en de procedure voor de herziening en aanpassing hiervan), alsmede de geboekte vooruitgang met betrekking tot de ontwikkeling van een procedure voor de herziening en aanpassing van deze lijsten en van een aanvraagformulier voor het opnemen van afvalstoffen in of het verwijderen van afvalstoffen van deze lijsten;

Overwegende dat de in Bijlagen I en III genoemde eigenschappen de eigenschappen moeten blijven voor de definiëring van de gevaarlijkheid van afvalstoffen voor de toepassing van dit Verdrag, dat met de door de Technische Werkgroep opgestelde Lijsten A en B een snelle procedure is gecreëerd voor de vergemakkelijking van de toepassing van dit Verdrag, met name van artikel 4A, door aan te geven welke afvalstoffen wel en welke afvalstoffen niet worden bedoeld in artikel 1, eerste lid, onder a, van dit Verdrag, en dat deze lijsten een zelfde status dienen te hebben;

Erop wijzend dat de afvalstoffenlijsten A en B een verdere uitwerking en precisering inhouden van het bepaalde in artikel 1, eerste lid, onder a, van dit Verdrag, rekening houdend met de Bijlagen I en III;

In het besef dat de Lijsten A en B niet uitputtend zijn;

Gelet op het feit dat de Open-ended ad hoc Committee tijdens haar derde vergadering heeft besloten de Conferentie der Partijen voor te stellen het mandaat van de Technische Werkgroep uit te breiden zodat deze de procedure voor de herziening en aanpassing van de lijsten van afvalstoffen op zich kan nemen, en het hiervoor bedoelde aanvraagformulier met dat doel aan te nemen, zoals beschreven in de nota inzake de overzichtslijsten van afvalstoffen en de toepasselijke procedure voor de herziening en aanpassing hiervan;

Gelet op het feit dat, ingevolge beslissing IV/6, de Technische Werkgroep is opgedragen de afvalstoffenlijsten te blijven bestuderen en aan de Conferentie aanbevelingen te doen met betrekking tot de herziening en aanpassing ervan;

Eveneens gelet op het feit dat, ingevolge beslissing IV/6, de Technische Werkgroep is opgedragen de procedure te bestuderen voor herziening en aanpassing van de afvalstoffenlijsten, met inbegrip van het aanvraagformulier voor opneming of verwijdering, zoals opgenomen in de nota inzake de overzichtslijsten van afvalstoffen en de toepasselijke procedure voor de herziening en aanpassing hiervan, en een voorstel voor verbetering te doen tijdens de vijfde vergadering van de Conferentie der Partijen;

Besluit de volgende wijziging en Bijlagen bij het Verdrag aan te nemen:

1. De volgende alinea's worden toegevoegd aan het einde van Bijlage I:

• „a. Teneinde de toepassing van dit Verdrag te vergemakkelijken en onder voorbehoud van de letters b, c en d, worden de in Bijlage VIII genoemde afvalstoffen gekarakteriseerd als gevaarlijk in de zin van artikel 1, eerste lid, onder a, van dit Verdrag en is artikel 1, eerste lid, onder a, van dit Verdrag niet van toepassing op de in Bijlage IX genoemde afvalstoffen.

• b. De opneming van een afvalstof in Bijlage VIII sluit niet uit dat, in bepaalde gevallen, een beroep wordt gedaan op Bijlage III om aan te tonen dat de afvalstof niet gevaarlijk is in de zin van artikel 1, eerste lid, onder a, van dit Verdrag.

• c. De opneming van een afvalstof in Bijlage IX sluit niet uit dat, in bepaalde gevallen, een afvalstof als schadelijk wordt gekarakteriseerd in de zin van artikel 1, eerste lid, onder a, van dit Verdrag, indien deze afvalstof een zodanige hoeveelheid stof bevat die is opgenomen in Bijlage I, dat dit een van de in Bijlage III genoemde eigenschappen oplevert.

• d. De Bijlagen VIII en IX hebben geen gevolgen voor de toepassing van artikel 1, eerste lid, onder a, van dit Verdrag ten behoeve van de karakterisering van de eigenschappen van afvalstoffen."

2. De volgende twee nieuwe bijlagen worden aan het Verdrag toegevoegd als Bijlagen VIII en IX.

Bijlage VIII

Lijst A

De in deze Bijlage opgenomen afvalstoffen worden gekarakteriseerd als gevaarlijk in de zin van artikel 1, eerste lid, onder a, van dit Verdrag en de opneming van een afvalstof in deze Bijlage sluit niet uit dat een beroep wordt gedaan op Bijlage III om aan te tonen dat deze afvalstof niet gevaarlijk is.

A1 Afval van metalen en metaalhoudende afvalstoffen

A1010 Afval van metalen en afvalstoffen en afvalstoffen bestaande uit legeringen van een of meer van de volgende metalen:

B4030 Gebruikte wegwerpfototoestellen met batterijen die niet in Lijst A zijn opgenomen.

De wijziging van Bijlage I behoefde ingevolge artikel 7, onderdeel f, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring der Staten-Generaal, alvorens voor het Koninkrijk in werking te kunnen treden.

De twee nieuwe Bijlagen VIII en IX behoefden ingevolge artikel 7, onderdeel b, van de Rijkswet goedkeuring en bekendmaking verdragen eveneens niet de goedkeuring der Staten-Generaal.

Ingevolge artikel 18, tweede lid, letter c, en derde lid, van het Verdrag zijn de wijziging en de nieuwe bijlagen op 6 november 1998 in werking getreden voor de Verdragsluitende Partijen, met uitzondering van Duitsland en Oostenrijk.

Wat het Koninkrijk der Nederlanden betreft, zijn de wijziging en de nieuwe bijlagen op 6 november 1998 voor Nederland in werking getreden.

Voor Oostenrijk zijn de wijziging en de nieuwe bijlagen op 26 oktober 1999 in werking getreden.

De volgende Staat heeft de bij besluit IV/9 van 27 februari 1999 tot stand gekomen wijziging van Bijlage I respectievelijk de totstandkoming van de twee nieuwe bijlagen VIII en IX bij het Verdrag aanvaard:

1 Op 13 maart 1996 is door de Verenigde Staten aan de depositaris de volgende mededeling gedaan:

“(1) It is the understanding of the United States of America that, as the Convention does not apply to vessels and aircraft that are entitled to sovereign immunity under international law, in particular to any warship, naval auxiliary, and other vessels or aircraft owned or operated by a State and in use on government, non-commercial service, each State shall ensure that such vessels or aircraft act in a manner consistent with this Convention, so far as is practicable and reasonable, by adopting appropriate measures that do not impair the operations or operational capabilities of sovereign immune vessels.

(2) It is the understanding of the United States of America that a State is a `Transit State' within the meaning of the Convention only if wastes are moved, or are planned to be moved, through its inland waterways, inland waters, or land territory.

(3) It is the understanding of the United States of America that an exporting State may decide that it lacks the capacity to dispose of wastes in an `environmentally sound and efficient manner' if disposal in the importing country would be both environmentally sound and economically efficient.

(4) It is the understanding of the United States of America that article 9 (2) does not create obligations for the exporting State with regard to cleanup, beyond taking such wastes back or otherwise disposing of them in accordance with the Convention. Further obligations may be determined by the parties pursuant to article 12.

Further, at the time the United States of America deposits its instrument of ratification of the Basel Convention, the United States will formally object to the declaration of any State which asserts the right to require its prior permission or authorization for the passage of vessels transporting hazardous wastes while exercising, under international law its right of innocent passage through the territorial sea or freedom of navigation in an exclusive economic zone."

Duitsland heeft op 4 november 1998 de depositaris de volgende mededeling gedaan overeenkomstig artikel 18, tweede lid, letter b, van het Verdrag: “At the Fourth Conference of the Parties to the Basel Convention held in Kuching, Malaysia from 23 to 27 February 1998, Germany agreed to the amendments and the new annexes. However, under the Basic Law for the Federal Republic of Germany formal approval by the legislative bodies is required before the amendmentsto the Convention enter into force. Unfortunately, it will not be possible to conclude this process within the six-month deadline.

For this reason and in conformity with Article 18 (2) (b) of the Basel Convention, the Federal Republic of Germany declares that it cannot at present accept the amendments to Annex I and the new Annexes VIII and IX to the Basel Convention".

Oostenrijk heeft op 30 oktober 1998 de depositaris de volgende mededeling gedaan overeenkomstig artikel 18, tweede lid, letter b, van het Verdrag: “Austria is not in a position to accept the amendment and the annexes to the Basel Convention on Transboundary Movements of Hazardous Wastes and their Disposal (Basel Convention) which were adopted by decision IV/9 of the fourth meeting of the Conference of the Parties to the Basel Convention.

This objection under Article 18 par. 2(b) of the said Convention has to be raised on purely technical grounds, due to the necessary parliamentary procedure in Austria, and will be lifted immediately once Parliament has accepted the amendment to Annex I as well as the new annexes VIII and IX.

In this context, due note should be taken of the fact that Austria is legally bound by the `Council Regulation on the supervision and control of shipments of waste within, into and out of the European Community'. An amendment to Annex V of this Council Regulation has been decided with the support of Austria on 30 September 1998 in order to take into full consideration those wastes featuring on any lists of wastes characterized as hazardous for the purposes of the Basel Convention.".
