Agreement between the Kingdom of the Netherlands and the Kingdom of Thailand on mutual administrative assistance in customs matters

The Kingdom of the Netherlands

and

the Kingdom of Thailand,

hereinafter referred to as the Contracting Parties,

Considering the importance of accurate assessment of customs duties and of ensuring proper enforcement by their customs administrations of prohibitions, restrictions and measures of control in respect of specific goods;

Considering that offences against customs law are prejudicial to the economic, commercial, fiscal, social, public health, public security and cultural interests of the Contracting Parties;

Considering that illegal cross-border trafficking in weapons, explosives, chemical, biological and nuclear substances, endangered species, hazardous goods as well as in narcotic drugs, psychotropic substances and precursors constitutes a danger to society;

Considering that automatic and advance exchange of high quality information will enhance risk management and such enhanced risk management contributes to more effective enforcement as well as facilitation of legitimate trade;

Recognizing the need for international co-operation in matters related to the application and enforcement of their customs laws;

Convinced that action against customs offences can be made more effective by close co-operation between their customs administrations based on mutually agreed legal provisions;

Having regard to the Recommendation on Mutual Administrative Assistance, the Declaration on the Improvement of Customs Co-operation and Mutual Administrative Assistance (the Cyprus Declaration) and the Resolution on Security and Facilitation of the International Trade Supply Chain, adopted in December 1953, June 2000 and June 2002, respectively, by the Customs Co-operation Council, now known as the World Customs Organization;

Having regard to international conventions containing prohibitions, restrictions and special measures of control in respect of specific goods;

Having regard also to the United Nations Universal Declaration of Human Rights of 1948;

Have agreed as follows:

CHAPTER I DEFINITIONS

Article 1

For the purposes of this Agreement:

a) “customs administration”

shall mean:

  • for the Kingdom of the Netherlands: the central administration responsible for the implementation of customs law;

  • for the Kingdom of Thailand: the Thai Customs Department;

b) “customs law”

shall mean any legal and administrative provisions applicable or enforceable by either customs administration in connection with the importation, exportation, transshipment, transit, storage and movement of goods, including legal and administrative provisions relating to measures of prohibition, restriction and control in respect of specific goods, and in connection with combating money laundering and financing of terrorism;

c) “customs offence”

shall mean any violation or attempted violation of customs law;

d) “information”

shall mean any data, whether or not processed or analysed, and documents, reports, and other communications in any format, including electronic, or certified, or authenticated copies thereof;

e) “international trade supply chain”

shall mean all processes involved in the cross-border movement of goods from the place of origin to the place of final destination;

f) “official”

shall mean any customs officer or other government agent designated by either customs administration;

g) “person”

shall mean any natural or legal person;

h) “personal data”

shall mean any data concerning an identified or identifiable natural person;

i) “requested administration”

shall mean the customs administration from which assistance is requested;

j) “requesting administration”

shall mean the customs administration which requests assistance;

k) “requested Party”

shall mean the Contracting Party whose customs administration is requested to provide assistance;

l) “requesting Party”

shall mean the Contracting Party whose customs administration requests assistance.

CHAPTER II SCOPE OF THE AGREEMENT

Article 2
  • 1. The Contracting Parties shall through their customs administrations provide each other with administrative assistance under the terms set out in this Agreement, for the proper application of customs law, for the prevention, investigation and combating of customs offences and to ensure the security of the international trade supply chain.

  • 2. AII assistance under this Agreement by either Contracting Party shall be provided in accordance with its legal and administrative provisions and within the limits of its customs administration's competence and available resources.

  • 3. This Agreement is without prejudice to the obligations of the Kingdom of the Netherlands under the legislation of the European Union concerning its present and future obligations as a Member State of the European Union and any legislation enacted to implement those obligations, as well as its present and future obligations resulting from international agreements between the Member States of the European Union.

  • 4. This Agreement covers mutual administrative assistance between the Contracting Parties and is not intended to have an impact on mutual legal assistance agreements between them. If mutual assistance is to be provided by other authorities of the requested Party, the requested administration shall indicate those authorities and where known the relevant agreement or arrangement applicable.

  • 5. The provisions of this Agreement shall not give rise to a right on the part of any person to impede the execution of a request for assistance.

CHAPTER III INFORMATION

Article 3 Information for the application and enforcement of customs law
  • 1. The customs administrations shall provide each other, either on request or on their own initiative, with information which helps to ensure the proper application of customs law, the prevention, investigation and combating of customs offences and the security of the international trade supply chain. Such information may relate to:

    • a) new law enforcement techniques which have proved their effectiveness;

    • b) new trends, means or methods of committing customs offences;

    • c) goods known to be the subject of customs offences, as well as transport and storage methods used in respect of those goods;

    • d) persons known to have committed a customs offence or suspected of being about to commit a customs offence;

    • e) any other data that can assist customs administrations with risk assessment for control and facilitation purposes.

  • 2. On request, the requested administration shall provide the requesting administration with information relative to instances where the latter has reason to doubt the information supplied to it by the person concerned in a matter related to the application of customs law.

Article 4 Information relating to customs offences
  • 1. Either customs administration shall, on request or on its own initiative, provide the customs administration of the other Contracting Party with information on activities, planned, ongoing, or completed, which appear to constitute a customs offence in the territory of the other Contracting Party.

  • 2. In cases that could involve substantial damage to the economy, public health, public security, including the security of the international trade supply chain, or any other vital interest of either Contracting Party, the customs administration of the other Contracting Party shall, wherever possible, supply such information on its own initiative without delay.

Article 5 Information relating to the lawfulness of the importation or exportation of goods

On request, the requested administration shall provide the requesting administration with information on:

  • a) whether goods exported from the territory of the requesting Party have been lawfully imported into the territory of the requested Party, and the customs procedure, if any, under which the goods have been placed;

  • b) whether goods imported into the territory of the requesting Party have been lawfully exported from the territory of the requested Party.

Article 6 Automatic transmission of information

The customs administrations may, by mutual arrangement in accordance with Article 16 of this Agreement, transmit to one another any information covered by this Agreement on an automatic basis.

Article 7 Advanced transmission of information

The customs administrations may, by mutual arrangement in accordance with Article 16 of this Agreement, transmit specific information to one another in advance of the arrival of consignments in the territory of the other Contracting Party.

CHAPTER IV COMMUNICATION OF REQUESTS

Article 8
  • 1. Requests for assistance under this Agreement shall be addressed directly to the customs administration of the other Contracting Party. Requests shall be made in writing or electronically and shall be accompanied by any information deemed useful for compliance with the request. The requested administration may require written confirmation of electronic requests. Where the circumstances so require, requests may be made verbally. Such requests shall be confirmed as soon as possible either in writing, or, if acceptable to both customs administrations, electronically.

  • 2. Requests made pursuant to paragraph 1 of this Article shall include the following details:

    • a) the name of the requesting administration;

    • b) the matter at issue, type of assistance requested, and reasons for the request;

    • c) a brief description of the case under review and the legal and administrative provisions that apply;

    • d) the names and addresses of the persons to whom the request relates, if known.

  • 3. Where the requesting administration requests that a certain procedure or methodology be followed, the requested administration shall comply with such a request subject to its national legal and administrative provisions.

CHAPTER V EXECUTION OF REQUESTS

Article 9 Means of obtaining information
  • 1. lf the requested administration does not have the information requested, it shall initiate inquiries to obtain that information.

  • 2. If the requested administration is not the appropriate authority to initiate inquiries to obtain the information requested, it may, in addition to indicating the appropriate authority, transmit the request to that authority.

Article 10 Presence of officials in the territory of the other Contracting Party

On request, officials designated by the requesting administration may, with the authorization of the requested administration and subject to conditions the latter may impose, for the purpose of investigating a customs offence:

  • a) take note of the content of the documents and any other information in respect of that customs offence in the offices of the requested administration, and be supplied with copies thereof;

  • b) be present during an inquiry conducted by the requested administration in the territory of the requested Party, which is relevant to the requesting administration; these officials shall only have an advisory role.

Article 11 Presence of officials of the requesting Contracting Party at the invitation of the requested administration

Where the requested administration considers it appropriate for officials of the requesting Party to be present when measures of assistance are carried out pursuant to a request, the requested administration may invite the participation of officials of the requesting Party subject to any terms and conditions it may specify.

Article 12 Provisions for visiting officials
  • 1. When officials of either Contracting Party are present in the territory of the other Contracting Party under the terms of this Agreement, they must at all times be able to furnish proof of their identity and official capacity.

  • 2. Officials of either Contracting Party shall, while in the territory of the other Contracting Party under the terms of this Agreement, enjoy the protection accorded to customs officers of the other Contracting Party to the extent provided by its legal and administrative provisions, and be responsible for any offence they might commit.

CHAPTER VI USE, CONFIDENTIALITY AND PROTECTION OF INFORMATION

Article 13
  • 1. Any information received under this Agreement shall be used only by the customs administrations of the Contracting Parties and solely for the purpose of administrative assistance under the terms set out in this Agreement.

  • 2. Notwithstanding paragraph 1 of this Article and subject to its relevant laws and regulations, the Contracting Party that supplied the information may, on request, authorize its use by other authorities or for other purposes, subject to any terms and conditions it may specify. Such use shall be in accordance with the legal and administrative provisions of the Contracting Party which seeks to use the information.

  • 3. Any information received under this Agreement shall be treated as confidential and shall, at least, be subject to the same confidentiality and protection as the same kind of information is subject to under the legal and administrative provisions of the Contracting Party where it is received.

  • 4. Any personal data exchanged under this Agreement shall, at least, be subject to the level of protection afforded to personal data in the national legal or administrative provisions of the Contracting Party whose customs administration provided these personal data.

  • 5. Contracting Parties shall provide each other with all legislation relevant to this Article. Personal data exchange will not begin before this legislation has been received. In case the legislation is amended, both Parties will inform each other about the amendments immediately.

CHAPTER VII EXEMPTIONS

Article 14
  • 1. Where any assistance requested under this Agreement may infringe the sovereignty, security, public policy or any other substantive national interest of the requested Party, or prejudice any legitimate commercial or professional interest, such assistance may be declined by that Contracting Party or provided subject to any terms and conditions it may require.

  • 2. Where the requesting administration would be unable to comply if a similar request were made by the requested administration, it shall draw attention to that fact in its request. Compliance with such a request shall be at the discretion of the requested administration.

  • 3. Assistance may be postponed if there are grounds to believe that it will interfere with an ongoing investigation, prosecution or proceeding. In such a case the requested administration shall consult with the requesting administration to determine if assistance can be provided subject to any terms and conditions the requested administration may require.

  • 4. If the requested administration considers that the effort required to fulfil a request is clearly disproportionate to the perceived benefit to the requesting administration, it may decline to provide the requested assistance.

  • 5. The requested administration declining or postponing assistance shall inform the requesting administration hereof without delay. The reasons for declining or postponement shall be given.

CHAPTER VIII COSTS

Article 15
  • 1. Subject to paragraphs 2 and 3 of this Article, the costs incurred in the application of this Agreement shall be borne by the requested Party.

  • 2. The costs of translators and interpreters other than Government employees shall be borne by the requesting Party.

  • 3. If the execution of a request requires expenses of a substantial or extraordinary nature, the Contracting Parties shall consult to determine the terms and conditions under which the request will be executed as well as the manner in which the costs shall be borne.

CHAPTER IX IMPLEMENTATION AND APPLICATION OF THE AGREEMENT

Article 16

The customs administrations shall jointly decide on detailed arrangements, within the framework of this Agreement, to facilitate the implementation and application of this Agreement.

CHAPTER X TERRITORIAL APPLICATION

Article 17
  • 1. As far as the Kingdom of Thailand is concerned, this Agreement shall be applicable in the territory of the Kingdom of Thailand.

  • 2. As far as the Kingdom of the Netherlands is concerned, this Agreement shall be applicable in:

    • a) its territory in Europe and the Caribbean parts of the Netherlands (the islands of Bonaire, Sint Eustatius and Saba);

    • b) Aruba;

    • c) Curaçao;

    • d) Sint Maarten.

  • 3. Notwithstanding paragraph 2 of this Article, as far as the Kingdom of the Netherlands is concerned, paragraph 3 of Article 2 is only applicable in its territory in Europe.

CHAPTER XI SETTLEMENT OF DISPUTES

Article 18
  • 1. The customs administrations shall endeavour to resolve disputes or other difficulties concerning the interpretation or application of this Agreement by mutual accord.

  • 2. The Contracting Parties shall endeavour in good faith to reach an amicable settlement of unresolved disputes or difficulties through friendly negotiations.

CHAPTER XII FINAL PROVISIONS

Article 19 Entry into force

This Agreement shall enter into force on the first day of the second month after the Contracting Parties have notified each other in writing through diplomatic channels that the constitutional or internal requirements for the entry into force of this Agreement have been met.

Article 20 Review

On request the Contracting Parties shall meet in order to review this Agreement.

Article 21 Duration and termination
  • 1. This Agreement is intended to be of unlimited duration but either Contracting Party may terminate it at any time by notification through diplomatic channels. As far as the Kingdom of the Netherlands is concerned, the Agreement may be terminated in respect of the entire Kingdom or in respect of any constituent part of the Kingdom mentioned in Article 17, paragraph 2.

  • 2. The termination shall take effect three months from the date of such notification to the other Contracting Party. Ongoing proceedings at the time of termination shall nonetheless be completed in accordance with the provisions of this Agreement.

IN WITNESS WHEREOF the undersigned, being duly authorised thereto, have signed this Agreement.

DONE AT Bangkok on the 27th day of September 2018, in duplicate, in the Netherlands, Thai and English languages, all texts being equally authentic. In case of divergence of interpretation the English text shall prevail.

Het Koninkrijk der Nederlanden

en

het Koninkrijk Thailand,

hierna te noemen de verdragsluitende partijen,

Gelet op het belang van een juiste vaststelling van de douanerechten en van het waarborgen van een juiste handhaving door hun douaneadministraties van verboden, beperkingen en controlemaatregelen met betrekking tot bepaalde goederen;

Overwegend dat inbreuken op de douanewetgeving schadelijk zijn voor de economische, fiscale, sociale en culturele belangen en de belangen op het gebied van de volksgezondheid, openbare orde en handel van de verdragsluitende partijen;

Overwegend dat de illegale grensoverschrijdende handel in wapens, explosieven, chemische, biologische en nucleaire stoffen, bedreigde dier- en plantensoorten, gevaarlijke stoffen alsmede in verdovende middelen, psychotrope stoffen en precursoren een gevaar voor de samenleving vormt;

Overwegend dat automatische en voorafgaande uitwisseling van hoogwaardige informatie het risicobeheer zal versterken en dat dergelijk risicobeheer bijdraagt aan een meer doeltreffende handhaving alsmede aan het vergemakkelijken van de legitieme handel;

Erkennend de noodzaak van internationale samenwerking ter zake van aangelegenheden die verband houden met de toepassing en handhaving van hun douanewetgeving;

Ervan overtuigd dat het optreden tegen inbreuken op de douanewetgeving doeltreffender kan worden door middel van nauwe samenwerking tussen hun douaneadministraties op basis van wederzijds overeengekomen wettelijke bepalingen;

Gelet op de Aanbeveling inzake wederzijdse administratieve bijstand, de Verklaring inzake verbetering van douanesamenwerking en wederzijdse administratieve bijstand (Verklaring van Cyprus) en de Resolutie inzake veiligheid en facilitatie van de internationale logistieke keten, aangenomen door de Internationale Douaneraad, tegenwoordig bekend als de Werelddouaneorganisatie, in respectievelijk december 1953, juni 2000 en juni 2002;

Gelet op internationale overeenkomsten die verboden, beperkingen en bijzondere controlemaatregelen met betrekking tot bepaalde goederen bevatten;

Tevens gelet op de Universele Verklaring van de Rechten van de Mens van de Verenigde Naties van 1948;

Zijn het volgende overeengekomen:

HOOFDSTUK I BEGRIPSOMSCHRIJVINGEN

Artikel 1

Voor de toepassing van dit Verdrag wordt verstaan onder:

a. „douaneadministratie”:
  • wat het Koninkrijk der Nederlanden betreft: de centrale administratie die verantwoordelijk is voor de toepassing van de douanewetgeving;

  • wat het Koninkrijk Thailand betreft: de Thaise Douanedienst;

b. „douanewetgeving”:

alle wettelijke en administratieve bepalingen die door een van de douaneadministraties worden toegepast of gehandhaafd in verband met de invoer, uitvoer, overslag, doorvoer, opslag en het vervoer van goederen, met inbegrip van wettelijke en administratieve bepalingen met betrekking tot verboden, beperkingen en controlemaatregelen met betrekking tot bepaalde goederen, en in verband met de bestrijding van witwassen en de financiering van terrorisme;

c. „inbreuk op de douanewetgeving”:

elke schending of poging tot schending van de douanewetgeving;

d. „informatie”:

alle gegevens, al dan niet bewerkt of geanalyseerd, en documenten, rapporten en andere mededelingen ongeacht in welke vorm, met inbegrip van de elektronische vorm, of gewaarmerkte of gelegaliseerde afschriften daarvan;

e. „internationale logistieke keten”:

alle processen die van toepassing zijn bij het grensoverschrijdend verkeer van goederen van de plaats van herkomst naar de uiteindelijke plaats van bestemming;

f. „functionaris”:

elke douaneambtenaar of andere regeringsambtenaar aangewezen door een van de douaneadministraties;

g. „persoon”:

elke natuurlijke persoon of rechtspersoon;

h. „persoonsgegevens”:

alle gegevens betreffende een geïdentificeerde of identificeerbare natuurlijke persoon;

i. „aangezochte administratie”:

de douaneadministratie die om bijstand in douanezaken wordt verzocht;

j. „verzoekende administratie”:

de douaneadministratie die om bijstand in douanezaken verzoekt;

k. „aangezochte partij”:

de verdragsluitende partij wier douaneadministratie om bijstand in douanezaken wordt verzocht;

l. „verzoekende partij”:

de verdragsluitende partij wier douaneadministratie om bijstand in douanezaken verzoekt.

HOOFDSTUK II REIKWIJDTE VAN HET VERDRAG

Artikel 2
  • 1. De verdragsluitende partijen verlenen elkaar door tussenkomst van hun douaneadministraties administratieve bijstand onder de in dit Verdrag genoemde voorwaarden ten behoeve van de juiste toepassing van de douanewetgeving, met het oog op het voorkomen, onderzoeken en bestrijden van inbreuken op die wetgeving, alsmede om de veiligheid van de internationale logistieke keten te waarborgen.

  • 2. Alle bijstand uit hoofde van dit Verdrag door een verdragsluitende partij wordt verleend in overeenstemming met haar wettelijke en administratieve bepalingen en binnen de grenzen van de bevoegdheden en beschikbare middelen van haar douaneadministratie.

  • 3. Dit Verdrag laat onverlet de verplichtingen van het Koninkrijk der Nederlanden ingevolge de wetgeving van de Europese Unie inzake zijn huidige en toekomstige verplichtingen als lidstaat van de Europese Unie en alle wetgeving die is vastgesteld om die verplichtingen na te komen, alsmede zijn huidige en toekomstige verplichtingen die voortvloeien uit internationale overeenkomsten tussen de lidstaten van de Europese Unie.

  • 4. Dit Verdrag heeft betrekking op de wederzijdse administratieve bijstand tussen de verdragsluitende partijen en is niet bedoeld van invloed te zijn op wederzijdse rechtshulpverdragen tussen hen. Indien wederzijdse bijstand moet worden verleend door andere autoriteiten van de aangezochte partij zal de aangezochte administratie deze autoriteiten en waar bekend het desbetreffende verdrag dat of de desbetreffende regeling die van toepassing is vermelden.

  • 5. Personen kunnen aan de bepalingen van dit Verdrag niet het recht ontlenen de uitvoering van een verzoek om bijstand te doen beletten.

HOOFDSTUK III INFORMATIE

Artikel 3 Informatie voor de toepassing en handhaving van de douanewetgeving
  • 1. De douaneadministraties verstrekken elkaar, op verzoek of uit eigen beweging, informatie ten behoeve van de juiste toepassing van de douanewetgeving met het oog op het voorkomen, onderzoeken en bestrijden van inbreuken op die wetgeving, alsmede om de veiligheid van de internationale logistieke keten te waarborgen. Deze informatie kan betrekking hebben op:

    • a. nieuwe wetshandhavingstechnieken die hun doeltreffendheid hebben bewezen;

    • b. nieuwe trends, middelen of werkwijzen bij het maken van inbreuken op de douanewetgeving;

    • c. goederen waarvan bekend is dat zij het voorwerp vormen van inbreuken op de douanewetgeving, alsmede de voor deze goederen toegepaste vervoer- en opslagmethoden;

    • d. personen van wie bekend is dat zij een inbreuk op de douanewetgeving hebben gemaakt of van wie wordt vermoed dat zij een inbreuk op de douanewetgeving gaan maken;

    • e. alle andere gegevens die de douaneadministraties van nut kunnen zijn bij de risicobeoordeling voor controle- en facilitatiedoeleinden.

  • 2. Op verzoek verstrekt de aangezochte administratie de verzoekende administratie informatie die betrekking heeft op gevallen waarin de laatste reden heeft te twijfelen aan door de betreffende persoon verstrekte informatie in een zaak die verband houdt met de toepassing van de douanewetgeving.

Artikel 4 Informatie met betrekking tot inbreuken op de douanewetgeving
  • 1. De douaneadministratie van een verdragsluitende partij verstrekt, op verzoek of uit eigen beweging, informatie aan de douaneadministratie van de andere verdragsluitende partij over voorgenomen, lopende of voltooide activiteiten die een inbreuk op de douanewetgeving op het grondgebied van de andere verdragsluitende partij lijken te vormen.

  • 2. In gevallen die aanzienlijke schade voor de economie, volksgezondheid, openbare orde, met inbegrip van de veiligheid van de internationale logistieke keten, of voor andere vitale belangen van een verdragsluitende partij met zich kunnen meebrengen, verstrekt de douaneadministratie van de andere verdragsluitende partij, waar mogelijk, uit eigen beweging en onverwijld zulke informatie.

Artikel 5 Informatie over de rechtmatigheid van de invoer of uitvoer van goederen

Op verzoek stelt de aangezochte administratie de verzoekende administratie op de hoogte van:

  • a. het feit of goederen die werden uitgevoerd uit het grondgebied van de verzoekende partij op rechtmatige wijze zijn ingevoerd in het grondgebied van de aangezochte partij en onder welke douaneregeling de goederen eventueel zijn geplaatst;

  • b. het feit of goederen die zijn ingevoerd in het grondgebied van de verzoekende partij op rechtmatige wijze werden uitgevoerd uit het grondgebied van de aangezochte partij.

Artikel 6 Automatisch verstrekken van informatie

De douaneadministraties kunnen elkaar, door middel van een wederzijdse regeling overeenkomstig artikel 16 van dit Verdrag, automatisch informatie die onder dit Verdrag valt verstrekken.

Artikel 7 Vooraf verstrekken van informatie

De douaneadministraties kunnen elkaar, door middel van een wederzijdse regeling overeenkomstig artikel 16 van dit Verdrag, specifieke informatie verstrekken voorafgaand aan de aankomst van zendingen op het grondgebied van de andere verdragsluitende partij.

HOOFDSTUK IV TOEZENDING VAN VERZOEKEN

Artikel 8
  • 1. Verzoeken om bijstand uit hoofde van dit Verdrag worden rechtstreeks aan de douaneadministratie van de andere verdragsluitende partij gericht. Verzoeken worden schriftelijk of elektronisch gedaan en gaan vergezeld van alle informatie die voor de inwilliging van het verzoek nuttig wordt geacht. De aangezochte administratie kan schriftelijke bevestiging van elektronische verzoeken verlangen. Wanneer de omstandigheden dit vereisen, kunnen verzoeken mondeling worden gedaan. Dergelijke verzoeken worden zo spoedig mogelijk hetzij schriftelijk, hetzij, indien beide douaneadministraties daarmee instemmen, elektronisch bevestigd.

  • 2. Verzoeken ingevolge het eerste lid van dit artikel bevatten de volgende gegevens:

    • a. de naam van de verzoekende administratie;

    • b. het onderwerp van en de reden voor het verzoek, alsmede de aard van de verzochte bijstand;

    • c. een korte beschrijving van de desbetreffende zaak en van de wettelijke en administratieve bepalingen die erop van toepassing zijn;

    • d. de namen en adressen van de personen op wie het verzoek betrekking heeft, indien bekend.

  • 3. Wanneer de verzoekende administratie verlangt dat een bepaalde procedure of methode gevolgd wordt, zal de aangezochte administratie aan een dergelijk verzoek voldoen met inachtneming van haar nationale wettelijke en administratieve bepalingen.

HOOFDSTUK V UITVOERING VAN VERZOEKEN

Artikel 9 Vergaren van informatie
  • 1. Indien de aangezochte administratie niet over de gevraagde informatie beschikt, stelt zij een onderzoek in om die informatie te vergaren.

  • 2. Indien de aangezochte administratie niet de bevoegde autoriteit is om een onderzoek in te stellen om de verzochte informatie te vergaren, kan zij, naast het aanwijzen van de bevoegde autoriteit, het verzoek aan die autoriteit doorzenden.

Artikel 10 Aanwezigheid van functionarissen op het grondgebied van de andere verdragsluitende partij

Door de verzoekende administratie aangewezen functionarissen kunnen, met instemming van de aangezochte administratie en onder voorwaarden die laatstgenoemde hieraan kan verbinden, ten behoeve van onderzoek naar een inbreuk op de douanewetgeving, op verzoek:

  • a. ten kantore van de aangezochte administratie documenten en alle andere informatie met betrekking tot die inbreuk op de douanewetgeving onderzoeken en daarvan afschriften verkrijgen;

  • b. aanwezig zijn bij een door de aangezochte administratie geleid onderzoek op het grondgebied van de aangezochte partij dat van belang is voor de verzoekende administratie; deze functionarissen zullen uitsluitend een adviserende rol hebben.

Artikel 11 Aanwezigheid van functionarissen van de verzoekende verdragsluitende partij op uitnodiging van de aangezochte administratie

Indien de aangezochte administratie het wenselijk acht dat functionarissen van de verzoekende partij aanwezig zijn wanneer, overeenkomstig een verzoek, bijstandsmaatregelen worden uitgevoerd, kan zij de verzoekende partij uitnodigen daartoe functionarissen ter beschikking te stellen, met inachtneming van alle door haar daaraan verbonden voorwaarden.

Artikel 12 Bepalingen ten aanzien van bezoekende functionarissen
  • 1. Indien functionarissen van de ene verdragsluitende partij aanwezig zijn op het grondgebied van de andere verdragsluitende partij uit hoofde van dit Verdrag, dienen zij te allen tijde in staat te zijn hun identiteit en officiële hoedanigheid aan te tonen.

  • 2. Functionarissen van de ene verdragsluitende partij genieten, gedurende hun verblijf uit hoofde van dit Verdrag op het grondgebied van de andere verdragsluitende partij, de bescherming die wordt toegekend aan douaneambtenaren van de andere verdragsluitende partij voor zover dit uit hoofde van de wettelijke en administratieve bepalingen van die verdragsluitende partij mogelijk is en zij zijn verantwoordelijk voor de strafbare feiten die zij eventueel begaan.

HOOFDSTUK VI GEBRUIK, VERTROUWELIJKHEID EN BESCHERMING VAN INFORMATIE

Artikel 13
  • 1. Uit hoofde van dit Verdrag ontvangen informatie mag slechts worden gebruikt door de douaneadministraties van de verdragsluitende partijen en uitsluitend ten behoeve van administratieve bijstand die wordt verleend onder de in dit Verdrag vervatte voorwaarden.

  • 2. Niettegenstaande het eerste lid van dit artikel en met inachtneming van haar relevante wetten en voorschriften, kan de verdragsluitende partij die de informatie heeft verstrekt, op verzoek, haar goedkeuring hechten aan het gebruik ervan door andere autoriteiten of voor andere doeleinden, met inachtneming van alle door haar daaraan verbonden voorwaarden. Dergelijk gebruik dient in overeenstemming te zijn met de wettelijke en administratieve bepalingen van de verdragsluitende partij die de informatie wil gebruiken.

  • 3. Uit hoofde van dit Verdrag ontvangen informatie wordt vertrouwelijk behandeld en daarvoor gelden ten minste dezelfde vertrouwelijkheid en bescherming als die welke voor soortgelijke informatie gelden krachtens de wettelijke en administratieve bepalingen van de verdragsluitende partij waar zij wordt ontvangen.

  • 4. Op uit hoofde van dit Verdrag uitgewisselde persoonsgegevens is een beschermingsniveau van toepassing dat ten minste gelijk is aan het beschermingsniveau voor persoonsgegevens dat gehanteerd wordt in de nationale wettelijke en administratieve bepalingen van de verdragsluitende partij wier douaneadministratie deze persoonsgegevens heeft verstrekt.

  • 5. De verdragsluitende partijen verschaffen elkaar alle wetgeving welke van belang is voor dit artikel. Persoonsgegevens worden pas uitgewisseld nadat de wetgeving is ontvangen. Wanneer de wetgeving wordt gewijzigd stellen beide partijen elkaar onverwijld in kennis van de wijzigingen.

HOOFDSTUK VII WEIGERINGSGRONDEN

Artikel 14
  • 1. Indien de bijstand waar uit hoofde van dit Verdrag om wordt verzocht een inbreuk zou kunnen vormen op de soevereiniteit, de veiligheid, de openbare orde of een ander wezenlijk nationaal belang van de aangezochte partij, of rechtmatige handels- of beroepsbelangen zou kunnen schaden, kan deze bijstand door die verdragsluitende partij worden geweigerd of worden verstrekt onder de voorwaarden die zij verlangt.

  • 2. Indien de verzoekende administratie niet in staat zou zijn een soortgelijk verzoek van de aangezochte administratie in te willigen, wijst zij daarop in haar verzoek. Inwilliging van een dergelijk verzoek wordt overgelaten aan het oordeel van de aangezochte administratie.

  • 3. De bijstand kan worden uitgesteld indien er gronden zijn om aan te nemen dat een lopend onderzoek of een lopende vervolging of procedure hiermee wordt doorkruist. In een dergelijk geval pleegt de aangezochte administratie overleg met de verzoekende administratie om te bepalen of de bijstand kan worden verleend onder de voorwaarden die de aangezochte administratie verlangt.

  • 4. Indien de aangezochte administratie van mening is dat de inspanningen die moeten worden verricht om aan een verzoek te voldoen duidelijk niet in verhouding staan tot het beoogde nut voor de verzoekende administratie, kan zij de gevraagde bijstand weigeren.

  • 5. De aangezochte administratie die de bijstand weigert of uitstelt, stelt de verzoekende administratie daarvan onverwijld in kennis. De weigering of het uitstel wordt met redenen omkleed.

HOOFDSTUK VIII KOSTEN

Artikel 15
  • 1. Met inachtneming van het tweede en derde lid van dit artikel, worden de kosten gemaakt bij de uitvoering van dit Verdrag gedragen door de aangezochte partij.

  • 2. De kosten van vertalers en tolken die niet in dienst zijn van de regering, worden gedragen door de verzoekende partij.

  • 3. Indien met de uitvoering van het verzoek aanmerkelijke kosten of kosten van buitengewone aard zullen zijn gemoeid, plegen de verdragsluitende partijen overleg om de voorwaarden te bepalen waaronder het verzoek zal worden uitgevoerd, alsmede de wijze waarop de kosten worden gedragen.

HOOFDSTUK IX UITVOERING EN TOEPASSING VAN HET VERDRAG

Artikel 16

De douaneadministraties besluiten gezamenlijk, binnen het kader van dit Verdrag, over nadere regelingen ter vergemakkelijking van de uitvoering en toepassing van dit Verdrag.

HOOFDSTUK X TERRITORIALE TOEPASSING

Artikel 17
  • 1. Wat het Koninkrijk Thailand betreft, is dit Verdrag van toepassing op het grondgebied van het Koninkrijk Thailand.

  • 2. Wat het Koninkrijk der Nederlanden betreft, is dit Verdrag van toepassing op:

    • a. zijn grondgebied in Europa en het Caribisch deel van Nederland (de eilanden Bonaire, Sint Eustatius en Saba);

    • b. Aruba;

    • c. Curaçao;

    • d. Sint Maarten.

  • 3. Niettegenstaande het tweede lid van dit artikel is, wat het Koninkrijk der Nederlanden betreft, het derde lid van artikel 2 uitsluitend van toepassing op zijn grondgebied in Europa.

HOOFDSTUK XI REGELING VAN GESCHILLEN

Artikel 18
  • 1. De douaneadministraties streven ernaar geschillen of andere problemen betreffende de interpretatie of toepassing van dit Verdrag in onderlinge overeenstemming op te lossen.

  • 2. De verdragsluitende partijen spannen zich constructief in om door vriendschappelijke onderhandelingen tot een minnelijke schikking te komen voor geschillen of problemen waarvoor geen oplossing is gevonden.

HOOFDSTUK XII SLOTBEPALINGEN

Artikel 19 Inwerkingtreding

Dit Verdrag treedt in werking op de eerste dag van de tweede maand nadat de verdragsluitende partijen elkaar langs diplomatieke weg schriftelijk ervan in kennis hebben gesteld dat aan de grondwettelijke of nationale vereisten voor de inwerkingtreding van dit Verdrag is voldaan.

Artikel 20 Herziening

Op verzoek komen de verdragsluitende partijen bijeen om het Verdrag te herzien.

Artikel 21 Duur en beëindiging
  • 1. Dit Verdrag wordt in beginsel voor onbepaalde tijd gesloten, maar elk van beide verdragsluitende partijen kan het te allen tijde bij kennisgeving langs diplomatieke weg beëindigen. Wat het Koninkrijk der Nederlanden betreft, kan het Verdrag worden beëindigd ten aanzien van het gehele Koninkrijk of ten aanzien van enig afzonderlijk deel van het Koninkrijk genoemd in artikel 17, tweede lid.

  • 2. De beëindiging wordt van kracht drie maanden na de datum van de kennisgeving aan de andere verdragsluitende partij. Lopende procedures op het tijdstip van beëindiging worden niettemin voltooid in overeenstemming met de bepalingen van dit Verdrag.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd, dit Verdrag hebben ondertekend.

GEDAAN TE Bangkok op 27 september 2018, in tweevoud, in de Nederlandse, de Thaise en de Engelse taal, waarbij alle teksten gelijkelijk authentiek zijn. In geval van verschil in interpretatie is de Engelse tekst doorslaggevend.

D. PARLEMENT

Het Verdrag behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het Verdrag kan worden gebonden.

G. INWERKINGTREDING

De bepalingen van het Verdrag zullen ingevolge artikel 19 in werking treden op de eerste dag van de tweede maand nadat de verdragsluitende partijen elkaar langs diplomatieke weg schriftelijk ervan in kennis hebben gesteld dat aan de grondwettelijke of nationale vereisten voor de inwerkingtreding van dit Verdrag is voldaan.
