Protocol tussen de Benelux-staten (het Koninkrijk België, het Groothertogdom Luxemburg, het Koninkrijk der Nederlanden) en de Macedonische Regering ter uitvoering van de Overeenkomst tussen de Europese Gemeenschap en de Voormalige Joegoslavische Republiek Macedonië betreffende de overname van personen die zonder vergunning op het grondgebied verblijven

de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden)

en

de Macedonische Regering,

Hierna genoemd „de Partijen”,

Op grond van artikel 19 van de op 18 september 2007 te Brussel ondertekende Overeenkomst tussen de Europese Gemeenschap en de Voormalige Joegoslavische Republiek Macedonië betreffende de overname van personen die zonder vergunning op het grondgebied verblijven,

Hierna genoemd „de Overeenkomst”,

Zijn het volgende overeengekomen:

Artikel 1 Definities en werkingssfeer

Voor de toepassing van dit Protocol wordt verstaan onder:

1. grondgebied:
  • a. voor de Benelux-Staten: het grondgebied van het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden voor zover het Verdrag betreffende de werking van de Europese Unie op dit grondgebied van toepassing is;

  • b. voor de Macedonische Regering: het Macedonische grondgebied.

2. begeleider(s):

de door de verzoekende Staat aangewezen persoon (of personen) belast met de begeleiding van de over te nemen of door te geleiden persoon.

Artikel 2 Bevoegde autoriteiten

  • 1. De Partijen wisselen uiterlijk dertig (30) dagen na ondertekening van dit Protocol via diplomatieke weg lijsten uit van de voor de uitvoering van de Overeenkomst bevoegde autoriteiten.

  • 2. De Partijen stellen elkaar onverwijld in kennis van iedere wijziging in deze lijsten.

Artikel 3 Overnameverzoek

  • 1. Een overnameverzoek wordt gedaan zodra de identiteit en de nationaliteit van de over te nemen persoon zijn vastgesteld of aannemelijk gemaakt krachtens de artikelen 8 en 9 van de Overeenkomst. Het overnameverzoek wordt ingediend conform artikel 7 van de Overeenkomst.

  • 2. Het overnameverzoek bevat voor zover mogelijk de volgende gegevens:

    • a. de persoonsgegevens van de over te nemen persoon (bv. voornaam, achternaam, geboortedatum en zo mogelijk geboorteplaats en laatste verblijfplaats alsook persoons-gegevens van zijn ouders);

    • b. de persoonsgegevens van de echtgeno(o)t(e) en/of minderjarige ongehuwde kinderen;

    • c. vermelding van de middelen waarmee het bewijs van of het prima facie bewijs inzake de nationaliteit, de doorreis, het voldoen aan de voorwaarden voor de overname van onder-danen van derde landen en staatlozen, de illegale binnenkomst en het illegale verblijf zal worden geleverd;

    • d. een foto van de betrokkene;

    • e. de handtekening van de vertegenwoordiger en de officiële stempel van de bevoegde autoriteit van de verzoekende Staat.

  • 3. Voor minderjarige ongehuwde kinderen wordt het volgende bij het overnameverzoek gevoegd:

    • a. de geboorteakte van de op het grondgebied van de verzoekende Staat geboren kinderen;

    • b. zo mogelijk de geboorteakte van de op het grondgebied van een derde Staat geboren kinderen;

    • c. een foto van elk meereizend kind van vijf (5) jaar of ouder.

  • 4. Het overnameverzoek bevat zo nodig ook de volgende gegevens:

    • a. een verklaring waaruit blijkt dat de over te dragen persoon hulp of verzorging nodig kan hebben, mits de betrokkene uitdrukkelijk met die verklaring heeft ingestemd;

    • b. andere beschermings- of veiligheidsmaatregelen dan wel gegevens over de gezondheid van de persoon die voor de overdracht van die persoon nodig kunnen zijn.

  • 5. Voor de indiening van zijn verzoek bij de bevoegde autoriteit van de aangezochte Staat maakt de verzoekende Staat gebruik van het formulier dat als bijlage 6 aan de Overeenkomst is gehecht.

Artikel 4 Antwoord op het overnameverzoek

  • 1. Het antwoord op het overnameverzoek wordt binnen de in artikel 10, lid 2, van de Overeenkomst gestelde termijnen toegezonden aan de bevoegde autoriteit van de verzoekende Staat. Een kopie van een positief antwoord wordt tevens aan de bevoegde diplomatieke of consulaire vertegenwoordiging van de aangezochte Staat verstrekt.

  • 2. Het antwoord bevat de volgende gegevens:

    • a. naam en adres van de bevoegde autoriteit van de aangezochte Staat, dossiernummer en datum van het antwoord op het verzoek;

    • b. naam en adres van de bevoegde autoriteit van de verzoekende Staat;

    • c. naam en voornamen, geboortedatum en –plaats van de betrokkene en, indien van toepassing, de gezinsleden;

    • d. een verklaring ter bevestiging dat er voor de betrokkene een overnameverplichting bestaat conform de bepalingen van de artikelen 2, 3, 4 of 5 van de Overeenkomst.

  • 3. In geval van een negatief antwoord geeft de aangezochte Staat aan waarom de identiteit van de betrokkene niet kon worden vastgesteld en/of waarom de overnameverplichting conform de bepalingen van de artikelen 2, 3, 4 of 5 van de Overeenkomst niet op hem van toepassing is.

  • 4. Voor zijn antwoord aan de bevoegde autoriteit van de verzoekende Staat maakt de aangezochte Staat gebruik van het formulier dat als bijlage 1 aan het Protocol is gehecht.

Artikel 5 Reisdocument

  • 1. In geval van een positief antwoord op het overnameverzoek voor eigen onderdanen geeft de bevoegde diplomatieke of consulaire vertegenwoordiging van de aangezochte Staat overeenkomstig artikel 2, lid 4, en artikel 4, lid 4, van de Overeenkomst een reisdocument voor de betrokkene af.

  • 2. Het reisdocument heeft een geldigheidsduur van dertig (30) dagen.

  • 3. In geval van een positief antwoord op het overnameverzoek voor onderdanen van derde landen of staatlozen geven de bevoegde autoriteiten van de verzoekende Staat overeenkomstig artikel 3, lid 4, en artikel 5, lid 4, van de Overeenkomst een reisdocument voor de betrokkene af.

  • 4. De diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij verstrekt onverwijld doch uiterlijk binnen drie (3) werkdagen een inreisvisum voor de terugkeer van de in lid 3 bedoelde persoon.

  • 5. Het inreisvisum heeft een geldigheidsduur van dertig (30) dagen.

  • 6. Wanneer de bevoegde autoriteit van de verzoekende Staat niet in staat is de betrokkene over te dragen voor de datum waarop het reisdocument of het visum verloopt, stelt zij de bevoegde autoriteit van de aangezochte Staat daarvan in kennis. Zodra de overdracht van de betrokkene kan plaatsvinden, verstrekt de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij binnen veertien (14) dagen volgend op een verzoek daartoe van de bevoegde autoriteit van de verzoekende Staat een nieuw reisdocument of visum met eenzelfde geldigheidsduur.

Artikel 6 Overnameprocedure

  • 1. De bevoegde autoriteit van de verzoekende Staat stelt de bevoegde autoriteit van de aangezochte Staat minimaal drie (3) werkdagen voor de geplande overdracht in kennis van haar voornemen daartoe over te gaan.

  • 2. Indien de verzoekende Staat de over te nemen persoon niet binnen de in artikel 10, lid 4, van de Overeenkomst genoemde termijn van drie (3) maanden kan overdragen, stelt zij de bevoegde autoriteit van de aangezochte Staat daarvan onverwijld in kennis. Zodra de feitelijke overdracht van de betrokkene kan plaatsvinden, brengt de bevoegde autoriteit van de verzoekende Staat de bevoegde autoriteit van de aangezochte Staat overeenkomstig de in artikel 10, lid 4, van de Overeenkomst bedoelde procedure en termijnen daarvan op de hoogte.

  • 3. Indien medische redenen vervoer over de weg of over zee rechtvaardigen, maakt de bevoegde autoriteit van de verzoekende Staat daarvan melding op het formulier dat als bijlage 6 aan de Overeenkomst is gehecht.

Artikel 7 Doorgeleidingsprocedure

  • 1. De doorgeleiding van onderdanen van derde landen of staatlozen wordt uitgevoerd overeenkomstig de artikelen 13 en 14 van de Overeenkomst.

  • 2. Het doorgeleidingsverzoek bevat voor zover mogelijk de volgende gegevens:

    • a. type van doorgeleiding (door de lucht of over land), eventuele andere staten van door-geleiding en beoogde eindbestemming;

    • b. de persoonsgegevens van de betrokkene (bv. voornaam, achternaam, meisjesnaam, andere namen die de betrokkene gebruikt of waaronder hij bekend staat, geboortedatum, geslacht en zo mogelijk geboorteplaats, nationaliteit, taal, aard en nummer van het reisdocument);

    • c. beoogde plaats van binnenkomst, tijdstip van overdracht en eventueel gebruik van begeleiders;

    • d. een verklaring waarin wordt gesteld dat volgens de verzoekende Staat is voldaan aan de voorwaarden van artikel 13, lid 2, van de Overeenkomst en dat er geen redenen bekend zijn voor een afwijzing op grond van artikel 13, lid 3, van de Overeenkomst.

  • 3. Het doorgeleidingsverzoek wordt ingediend bij de bevoegde autoriteit van de aangezochte Staat door middel van het formulier dat als bijlage 7 aan de Overeenkomst is gehecht.

  • 4. Het doorgeleidingsverzoek wordt minimaal zeven (7) dagen voor de doorgeleiding ingediend bij de aangezochte Staat.

  • 5. De aangezochte Staat antwoordt onverwijld doch binnen vijf (5) dagen op het verzoek.

  • 6. Voor zijn antwoord aan de bevoegde autoriteit van de verzoekende Staat maakt de aangezochte Staat gebruik van het formulier dat als bijlage 2 aan het Protocol is gehecht.

Artikel 8 Ondersteuning van de doorgeleiding

  • 1. Indien de verzoekende Staat ondersteuning van een specifieke doorgeleiding door de autoriteiten van de aangezochte Staat noodzakelijk acht, geeft hij dit aan in het formulier dat als bijlage 7 aan de Overeenkomst is gehecht. De bevoegde autoriteiten treden zo nodig met elkaar in overleg.

  • 2. In het antwoord op het doorgeleidingsverzoek vermeldt de aangezochte Staat onder punt 3 (Bijzonderheden) van het formulier dat als bijlage 2 aan dit Protocol is gehecht, of hij in de gevraagde ondersteuning kan voorzien.

  • 3. Indien de betrokkene wordt begeleid, geschieden de bewaking en het aan boord brengen onder het gezag van de aangezochte Staat.

Artikel 9 Verplichtingen van de begeleiders

  • 1. Op het grondgebied van de aangezochte Staat moeten de begeleiders in alle omstandigheden het recht van de aangezochte Staat naleven.

  • 2. De begeleiders mogen, bij afwezigheid van ter zake bevoegde ambtenaren van de aangezochte Staat of ter ondersteuning van deze ambtenaren, in reactie op een onmiddellijke en ernstige dreiging op redelijke en proportionele wijze optreden om zichzelf te beschermen en te voorkomen dat de betrokkene vlucht, zichzelf of derden letsel toebrengt dan wel schade aan goederen veroorzaakt.

  • 3. De begeleiders voeren hun taak ongewapend en in burgerkledij uit. Zij dienen in het bezit te zijn van een begeleidingsvergunning, een machtiging tot overname of doorgeleiding en een identiteitsbewijs.

  • 4. De aangezochte Staat verleent de begeleiders bescherming en bijstand overeenkomstig zijn nationale wetgeving.

Artikel 10 Grensovergangen

  • 1. De Partijen wisselen uiterlijk dertig (30) dagen na ondertekening van dit Protocol via diplomatieke weg lijsten uit van de ingevolge de Overeenkomst voor overname of doorgeleiding aangewezen grensovergangen.

  • 2. De Partijen stellen elkaar onverwijld in kennis van iedere wijziging in deze lijsten.

  • 3. De bevoegde autoriteiten kunnen op ad-hocbasis overeenkomen gebruik te maken van andere grensovergangen voor overname of doorgeleiding.

Artikel 11 Kosten

  • 1. De kosten verbonden aan het proces van overname en doorgeleiding worden toegewezen als omschreven in artikel 15 van de Overeenkomst.

  • 2. Alle door de aangezochte Staat gemaakte kosten worden door de verzoekende Staat vergoed door middel van een bankgiro binnen zestig (60) dagen te rekenen van de dag van overhandiging van de factuur.

Artikel 12 Vergadering van deskundigen

  • 1. De Partijen werken samen bij het analyseren van kwesties omtrent de toepassing van dit Protocol.

  • 2. Hiertoe kan een vergadering van deskundigen bijeenkomen op verzoek van één van de Partijen.

Artikel 13 Taal en communicatie

  • 1. De Partijen communiceren met elkaar in de Engelse taal.

  • 2. De bevoegde autoriteiten communiceren per fax of post. Indien beide Partijen daarmee instemmen, kan eveneens per e-mail of via andere technische middelen worden gecommuniceerd.

Artikel 14 Bijlagen

De bijlagen 1 en 2 vormen een integrerend onderdeel van dit Protocol.

Artikel 15 Wijzigingen

  • 1. Dit Protocol en zijn bijlagen kunnen in onderlinge overeenstemming tussen de Partijen worden gewijzigd.

  • 2. Wijzigingen van het Protocol treden in werking in overeenstemming met de procedure vervat in artikel 17, eerste en tweede lid.

  • 3. Wijzigingen van de Bijlagen treden in werking op een door de partijen te bepalen datum.

Artikel 16 Depositaris

Het Koninkrijk België is depositaris van dit Protocol. De depositaris voorziet alle Staten van een voor eensluidend gewaarmerkt afschrift van het origineel.

Artikel 17 Inwerkingtreding, duur en opzegging

  • 1. De Partijen stellen elkaar en de depositaris in kennis van de voltooiing van de benodigde nationale wettelijke procedures voor de inwerkingtreding van het Protocol.

  • 2. Overeenkomstig artikel 19, lid 2, van de Overeenkomst treedt dit Protocol in werking op de eerste dag van de tweede maand na kennisgeving door de depositaris aan het Gemengd Comité overname dat de daarvoor noodzakelijke interne procedures door iedere Partij zijn voltooid. Een afschrift van deze kennisgeving wordt door de depositaris aan iedere Partij verstrekt.

  • 3. Overeenkomstig artikel 20 van de Overeenkomst heeft dit Protocol voorrang boven de bepalingen van de Overeenkomst tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg, het Koninkrijk der Nederlanden) en de Macedonische Regering betreffende de overname van onregelmatig verblijvende personen, gedaan te Voorburg op 30 mei 2006. Deze Overeenkomst blijft van kracht tussen Curaçao, Sint Maarten en het Caribisch deel van Nederland (Bonaire, Sint Eustatius en Saba) en de Macedonische Regering.

  • 4. Dit Protocol wordt gelijktijdig met de opzegging van de Overeenkomst opgezegd.

GEDAAN te Brussel, op 30 juli 2012, in de Engelse, de Franse, de Nederlandse en de Macedonische taal, zijnde alle teksten gelijkelijk authentiek. In geval van verschillen in interpretatie is de Engelse tekst doorslaggevend.

Protocol between the States of the Benelux (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Macedonian Government on the implementation of the Agreement between the European Community and the Former Yugoslav Republic of Macedonia on the readmission of persons residing without authorisation

The States of the Benelux (the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands),

and

the Macedonian Government,

Hereafter referred to as “the Parties”,

On the basis of Article 19 of the Agreement between the European Community and the Former Yugoslav Republic of Macedonia on the readmission of persons residing without authorisation, signed on 18 September 2007 at Brussels,

Hereafter referred to as “the Agreement”,

Have agreed as follows:

Article 1 Definitions and scope

For the purpose of this Protocol, the following terms shall have the following meaning:

1. territory:
  • a) for the States of the Benelux: the territory of the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands in which the Treaty on the functioning of the European Union is applicable;

  • b) for the Macedonian Government: the Macedonian territory.

2. escort(s):

the person (or persons) assigned by the Requesting State to accompany the person to be readmitted or who is in transit.

Article 2 Competent authorities

  • 1. The Parties shall exchange lists of the competent authorities for the implementation of the Agreement ultimately thirty (30) days after signing this Protocol, through diplomatic channels.

  • 2. The Parties shall notify each other of any changes in these lists without delay.

Article 3 Readmission application

  • 1. A readmission application shall be made once the identity and nationality of the person to be readmitted have been established or may be validly assumed in accordance with Articles 8 and 9 of the Agreement. The readmission application shall be made in accordance with Article 7 of the Agreement.

  • 2. To the extent possible, the readmission application contains the following:

    • a) the particulars of the person to be readmitted (e.g. given names, surnames, date of birth, and – where possible – place of birth, and the last place of residence and particulars of their parents);

    • b) the particulars of spouses and/or minor unmarried children;

    • c) indication of the means with which proof or prima facie evidence of nationality, transit, the conditions for the readmission of third-country nationals and stateless persons and unlawful entry and residence will be provided;

    • d) photograph of the person concerned;

    • e) the signature of the representative and the official stamp of the competent authority of the Requesting State.

  • 3. For minor unmarried children, the following shall be enclosed to the readmission application:

    • a) the birth certificates of children born within the territory of the Requesting State;

    • b) if possible, the birth certificates of children born within the territory of a third state;

    • c) a photograph of each accompanying child aged five (5) years or older.

  • 4. If necessary, the readmission application shall also contain the following:

    • a) a statement indicating that the person to be transferred may need help or care, provided the person concerned has explicitly consented to the statement;

    • b) any other protection, security measure or information concerning the health of the person, which may be necessary in the individual transfer case.

  • 5. The Requesting State shall submit the application to the competent authority of the Requested State using the form attached as Annex 6 to the Agreement.

Article 4 Response to the readmission application

  • 1. The response to the readmission application shall be sent to the competent authority of the Requesting State within the time limits stipulated in Article 10, paragraph 2, of the Agreement. A copy of a positive response shall also be sent to the competent diplomatic or consular representation of the Requested State.

  • 2. The response shall contain the following data:

    • a) the name and address of the competent authority of the Requested State, the case number, and the date of the reply;

    • b) the name and address of the competent authority of the Requesting State;

    • c) the surname, given names and date and place of birth of the person concerned and, if applicable, family members;

    • d) a statement confirming that a readmission obligation exists with respect to the person in question, in accordance with Articles 2, 3, 4 or 5 of the Agreement.

  • 3. In the event of a negative response the Requested State shall indicate the reasons why the identity of the person concerned could not be established and/or why the readmission obligation as referred to in Articles 2, 3, 4 or 5 of the Agreement does not apply to the person concerned.

  • 4. The Requested State shall respond to the competent authority of the Requesting State using the form attached as Annex 1 to the Protocol.

Article 5 Travel document

  • 1. In the event of a positive response to the readmission application for own nationals, in accordance with Article 2, paragraph 4, and Article 4, paragraph 4, of the Agreement, the competent diplomatic mission or consular representation of the Requested State shall issue a travel document for the person concerned.

  • 2. The travel document has a validity of thirty (30) days.

  • 3. In the event of a positive response to the readmission application for third-country nationals or stateless persons, in accordance with Article 3, paragraph 4, and Article 5, paragraph 4, of the Agreement, the competent authorities of the Requesting State shall issue a travel document for the person concerned.

  • 4. The diplomatic or consular representation of the Requested Party shall issue an entry visa for the purpose of return of the person mentioned in paragraph 3, without delay but no later than within three (3) working days.

  • 5. The entry visa has a validity of thirty (30) days.

  • 6. If the competent authority of the Requesting State is unable to transfer the person concerned before the date on which the travel document or the visa expires, it shall notify the competent authority of the Requested State accordingly. As soon as the transfer of the person concerned can take place, the diplomatic or consular representation of the Requested Party shall issue a new travel document or a visa with the same validity period within fourteen (14) calendar days upon request of the competent authority of the Requesting State.

Article 6 Readmission procedure

  • 1. The competent authority of the Requesting State shall notify the competent authority of the Requested State of the intended transfer at least three (3) working days in advance.

  • 2. If the Requesting State cannot transfer the person to be readmitted within the time limit of three (3) months, as specified in Article 10, paragraph 4, of the Agreement, it shall notify the competent authority of the Requested State without delay. As soon as the actual transfer of the person concerned can take place, the competent authority of the Requesting State shall inform the competent authority of the Requested State in accordance with the procedure and time limits laid down in Article 10, paragraph 4, of the Agreement.

  • 3. In the event of medical reasons which justify transport by road or by sea, the competent authority of the Requesting State shall mention this on the form attached as Annex 6 to the Agreement.

Article 7 Transit procedure

  • 1. The transit of a third-country national or a stateless person shall be carried out according to Articles 13 and 14 of the Agreement.

  • 2. To the extent possible, the transit application shall contain the following:

    • a) type of transit (by air or land), possible other States of transit and intended final destination;

    • b) the particulars of the person concerned (e.g. given name, surname, maiden name, other names used/by which known or aliases, date of birth, sex and – where possible – place of birth, nationality, language, type and number of travel document);

    • c) envisaged point of entry, time of transfer and possible use of escorts;

    • d) a declaration that in the view of the Requesting State the conditions pursuant to Article 13, paragraph 2, of the Agreement are met, and that no reasons for a refusal pursuant to Article 13, paragraph 3, of the Agreement are known of.

  • 3. The transit application shall be sent to the competent authority of the Requested State using the form attached as Annex 7 to the Agreement.

  • 4. The transit application shall be sent to the Requested State no later than seven (7) calendar days prior to the transit.

  • 5. The Requested State shall respond without delay but within five (5) calendar days.

  • 6. The Requested State shall respond to the competent authority of the Requesting State using the form attached as Annex 2 to the Protocol.

Article 8 Support during transit

  • 1. If the Requesting State deems it necessary to have the support of the authorities of the Requested State for a particular transit, it shall indicate this on the form attached as Annex 7 to the Agreement. The competent authorities shall consult each other if necessary.

  • 2. In its response to the transit application the Requested State shall also state whether it can provide the requested support, under point 3 of the form attached as Annex 2 to this Protocol (Special observations).

  • 3. Escorts guarding and assisting the embarkation of the person concerned operate under the authority of the Requested State.

Article 9 Obligations for escorts

  • 1. On the territory of the Requested State escorts shall adhere to the law of the Requested State in all circumstances.

  • 2. In the absence of any officials of the Requested State who are authorised to take necessary action or in order to support such officials, escorts may respond to an immediate and serious threat in a reasonable and proportionate manner in order to protect himself and to prevent the person concerned from escaping, injuring himself or third parties or causing damage to property.

  • 3. Escorts shall perform their task unarmed and in civilian clothes. They must be in possession of an escort authorisation, permission for readmission or transit and an identity document.

  • 4. The Requested State shall provide protection and assistance to the escorts in accordance with its national legislation.

Article 10 Border crossing points

  • 1. The Parties shall exchange lists of border crossing points designated for readmission or transit pursuant to the Agreement, ultimately thirty (30) days after signing this Protocol, through diplomatic channels.

  • 2. The Parties shall notify each other of any changes in these lists without delay.

  • 3. The competent authorities may agree on the use of other border crossing points for readmission or transit on a case by case basis.

Article 11 Costs

  • 1. The costs resulting from the process of readmission and transit shall be borne as specified in Article 15 of the Agreement.

  • 2. The Requesting State shall reimburse to the Requested State all the costs by bank transfer within sixty (60) days following the date of delivery of the invoice.

Article 12 Expert meeting

  • 1. The Parties shall co-operate on the analysis of the issues relating to the implementation of this Protocol.

  • 2. For this purpose, an expert meeting can be organized upon request of one of the Parties.

Article 13 Language and communication

  • 1. The Parties shall communicate with each other in the English language.

  • 2. The competent authorities shall communicate by fax or postal mail. If both Parties agree, communication can also be done through e-mail or other technical means.

Article 14 Annexes

Annexes 1 and 2 shall constitute an integral part of this Protocol.

Article 15 Amendments

  • 1. This Protocol and its Annexes may be amended by mutual agreement between the Parties.

  • 2. Any amendments to the Protocol shall enter into force in accordance with the procedure laid down in Article 17, paragraphs 1 and 2.

  • 3. Any amendments to the Annexes shall enter into force on a date to be determined by the Parties.

Article 16 Depositary

The Kingdom of Belgium is depositary of this Protocol. The depositary shall issue each State with a true copy of the original.

Article 17 Entry into force, duration and termination

  • 1. The Parties shall notify the depositary, as well as each other, of the completion of their national legal procedures necessary for the entry into force of the Protocol.

  • 2. This Protocol shall, in accordance with Article 19, paragraph 2, of the Agreement, enter into force on the first day of the second month after the Joint Readmission Committee has been notified by the depositary that all Parties have completed their respective internal procedures necessary therefore. A copy of this notification shall be distributed by the depositary among all Parties.

  • 3. In accordance with Article 20 of the Agreement this Protocol shall take precedence over the provisions of the Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Macedonian Government on the readmission of persons residing without authorisation, done at Voorburg on 30 May 2006. This Agreement shall remain in force between Curaçao, Sint Maarten and the Caribbean part of the Netherlands (Bonaire, Sint Eustatius and Saba) and the Macedonian Government.

  • 4. This Protocol terminates simultaneously with the termination of the Agreement.

DONE at Brussels, on 30 July 2012, in the English, French, Dutch and Macedonian languages, each version being equally authentic. In case of divergence of interpretation, the English text shall prevail.

D. PARLEMENT

Het Protocol, met Bijlagen, behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het Protocol, met Bijlagen, kan worden gebonden.

G. INWERKINGTREDING

De bepalingen van het Protocol, met Bijlagen, zullen ingevolge artikel 17, tweede lid, van het Protocol juncto artikel 19, tweede lid, van de Overeenkomst tussen de Europese Gemeenschap en Macedonië van 18 september 2007, in werking treden op de eerste dag van de tweede maand na kennisgeving door de depositaris aan het Gemengd Comité overname dat de daarvoor noodzakelijke interne procedures door iedere partij zijn voltooid.
