Tijdens de van 17 tot en met 21 september 2007 te Montreal gehouden negentiende vergadering van de Partijen bij het Protocol is in overeenstemming met artikel 2, negende lid, van het Protocol een aantal aanpassingen aangenomen (middels Besluit XIX/6). De Engelse tekst¹⁾ van die aanpassingen luidt als volgt:

Adjustments agreed by the Nineteenth Meeting of the Parties relating to the controlled substances in group I of Annex C of the Montreal Protocol (hydrochlorofluorocarbons)

The Nineteenth Meeting of the Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer decides to adopt, in accordance with the procedure laid down in paragraph 9 of Article 2 of the Montreal Protocol, and on the basis of assessments made pursuant to Article 6 of the Protocol, adjustments and reductions of production and consumption of the controlled substances in Group I of Annex C to the Protocol, as follows:

Article 2F: Hydrochlorofluorocarbons

• 1. The current paragraph 8 of Article 2F of the Protocol shall become paragraph 2, and the current paragraph 2 shall become paragraph 3.

• 2. The current paragraphs 3 to 6 shall be replaced by the following paragraphs, which shall be numbered paragraphs 4 to 6:

  • “4. Each Party shall ensure that for the twelve-month period commencing on 1 January 2010, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substances in Group I Annex C does not exeeed, annually, twenty-five per cent of the sum referred to in paragraph 1 of this Article. Each Party producing one or more of these substances shall, for the same periods, ensure that its calculated level of production of the controlled substances in Group I of Annex C does not exceed, annually, twenty-five per cent of the calculated level referred to in paragraph 2 of this Article. However, in order to satisfy the basic domestic needs of the Parties operating under paragraph 1 of Article 5, its calculated level of production may exceed that limit by up 10 ten per cent of its calculaled level of production of the conlrolled substances in Group I of Annex C as referred to in paragraph 2.

  • 5. Each Party shall ensure that for the twelve-month period commencing on 1 January 2015, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substances in Group I of Annex C does not exceed, annually, ten per cent of the sum referred to in paragraph 1 of this Article. Each Party producing one or more of these substances shall, for the same periods, ensure that its calculated level of production of the controlled substances in Group I of Annex C does not exceed, annually, ten per cent of the calculated level referred to in paragraph 2 of this Article. However, in order to satisfy the basic domestic needs of the Parties operating under paragraph 1 of Article 5, its calculated level of production may exceed that limit by up to ten per cent of its calculated level of production of the controlled substances in Group I of Annex C as referred to in paragraph 2.

  • 6. Each Party shall ensure. that for the twelve-month period commencing on 1 January 2020, and in each twelve-month period thereafter, its calculated level of consumption of the eontrolled substances in Group I of Annex C does not exceed zero. Eaeh Party producing one or more of these substances shall, for the same periods, ensure that its calculated level of production of the controlled substances in Group I of Annex C does not exceed zero. However:

    • a) Each Party may exceed that limit on consumption by up to zero point five per cent of the sum referred to in paragraph 1 of this Artic1e in any such twelve¬month period ending before 1 January 2030, provided that such consumption shall be restricted to the servicing of refrigeration and air-conditioning equipment existing on 1 January 2020;

    • b) Each Party may exeeed that limit on production by up to zero point five per cent of the average referred to in paragraph 2 of this Article in any such twelve-month period ending before 1 January 2030, provided that such production shall be restricted to the servicing of refrigeration and air-conditioning equipment existing on 1 January 2020.”

Article 5: Special situation of developing countries

• 3. The current sub-paragraphs (a) and (b) of paragraph 8 ter of Article 5 shall be replaced by the following sub-paragraphs, which shall become sub-paragraphs (a) to (e):

  • “a) Each Party operating under paragraph 1 of this Article shall ensure that for the twelve-month period commencing on 1 January 2013, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substances in Group I of Annex C does not exceed, annually, the average of its calculated levels of consumption in 2009 and 2010. Each Party operating under paragraph 1 of this Article shall ensure that for the twelve-month period commencing on 1 January 2013 and in each twelve-month period thereafter, its calculated level of production of the controlled substances in Group I of Annex C does not exceed, annually, the average of its calculated levels of production in 2009 and 2010;

  • b) Each Party operating under paragraph 1 of this Article shall ensure that for the twelve-month period commencing on 1 January 2015, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substances in Group I of Annex C does not exceed, annually, ninety per cent of the average of its calculated levels of consumption in 2009 and 2010. Each such Party producing one or more of these substances shall, for the same periods, ensure that its calculated level of production of the controlled substances in Group I of Annex C does not exceed, annually, ninety per cent of the average of its calculated levels of production in 2009 and 2010;

  • c) Each Party operating under paragraph 1 of this Article shall ensure that for the twelve-month period eommencing on 1 January 2020, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substances in Group I of Annex C does not exceed, annually, sixty-five per cent of the average of its calculated levels of consumption in 2009 and 2010. Each such Party producing one or more of these substances shall, for the same periods, ensure that its calculated level of production of the controlled substances in Group I of Annex C does not exceed, annually, sixty-five per cent of the average of its calculated levels of production in 2009 and 2010;

  • d) Each Party operating under paragraph 1 of this Article shall ensure that for the twelve-month period commencing on 1 January 2025, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substances in Group I of Annex C does not exceed, annually, thirty-two point five per cent of the average of its calculated levels of consumption in 2009 and 2010. Each such Party producing one or more of these substances shall, for the same periods, ensure that its calculated level of production of the controlled substances in Group I of Annex C does not exceed, annually, thirty-two point five per cent of the average of its calculated levels of production in 2009 and 2010;

  • e) Each Party operating under paragraph 1 of this Article shall ensure that for the twelve-month period commencing on 1 January 2030, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substances in Group I of Annex C does not exceed zero. Each such Party producing one or more of these substances shall, for the same periods, ensure that its calculated level of production of the controlled substances in Group I of Annex C does not exceed zero. However:

    • (i) Each such Party may exceed that limit on consumption in any such twelve-month period so long as the sum of its calculated levels of consumption over the ten-year period from 1 January 2030 to 1 January 2040, divided by ten, does not exceed two point five per cent of the average of its calculated levels of consumption in 2009 and 2010, and provided that such consumption shall be restricted to the servicing of refrigeration and air-conditioning equipment existing on 1 January 2030;

    • (ii) Each such Party may exceed that limit on production in any such twelve-month period so long as the sum of its calculated levels of production over the ten-year period from 1 January 2030 to 1 January 2040, divided by ten, does not exceed two point five per cent of the average of its calculated levels of production in 2009 and 2010, and provided that such production shall be restricted to the servicing of refrigeration and air-conditioning equipment existing on 1 January 2030.”

• 4. The current sub-paragraphs (c) and (d) of paragraph 8 ter of Article 5 shall become sub-paragraphs (f) and (g).

De vertaling van de aanpassingen aangenomen tijdens de van 17 tot en met 21 september 2007 te Montreal gehouden negentiende vergadering van de Partijen bij het Protocol luidt als volgt:

Aanpassingen overeengekomen door de Negentiende Vergadering van de Partijen met betrekking tot aan uitworpbeheersing onderworpen stoffen uit Groep I van Bijlage C van het Protocol van Montreal (chloorfluorkoolwaterstoffen)

De Negentiende Vergadering van de Partijen bij het Protocol van Montreal betreffende stoffen die de ozonlaag afbreken besluit, in overeenstemming met de procedure zoals voorzien in artikel 2, negende lid, van het Protocol van Montreal en op basis van beoordelingen ingevolge artikel 6 van het Protocol, tot aanneming van de onderstaande aanpassingen en verminderingen van de productie en het gebruik van aan uitworpbeheersing onderworpen stoffen uit Groep I van Bijlage C van het Protocol:

Artikel 2F: Chloorfluorkoolwaterstoffen

• 1. Het huidige achtste lid van artikel 2F van het Protocol wordt het tweede lid, en het huidige tweede lid wordt het derde lid.

• 2. Het huidige derde, vierde, vijfde en zesde lid worden vervangen door de onderstaande leden, die het vierde, vijfde en zesde lid worden:

  • „4. Elke Partij verzekert dat gedurende het tijdvak dat begint op 1 januari 2010 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan vijfentwintig procent van de in het eerste lid van dit artikel bedoelde som. Elke Partij die een of meer van deze stoffen produceert, verzekert, voor dezelfde tijdvakken, dat haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan vijfentwintig procent van het in het tweede lid van dit artikel bedoelde niveau. Om te voorzien in de fundamentele binnenlandse behoeften van de onder de werking van het eerste lid van artikel 5 vallende Partijen, mag haar berekende productie deze limiet evenwel overschrijden met ten hoogste tien procent van haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen, zoals bedoeld in het tweede lid.

  • 5. Elke Partij verzekert dat gedurende het tijdvak dat begint op 1 januari 2015 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan tien procent van de in het eerste lid van dit artikel bedoelde som. Elke Partij die een of meer van deze stoffen produceert, verzekert, voor dezelfde tijdvakken, dat haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan tien procent van het in het tweede lid van dit artikel bedoelde niveau. Om te voorzien in de fundamentele binnenlandse behoeften van de onder de werking van het eerste lid van artikel 5 vallende Partijen, mag haar berekende productie deze limiet evenwel overschrijden met ten hoogste tien procent van haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen, zoals bedoeld in het tweede lid.

  • 6. Elke Partij verzekert dat gedurende het tijdvak dat begint op 1 januari 2020 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen tot nul is teruggebracht. Elke Partij die een of meer van deze stoffen produceert, verzekert, voor dezelfde tijdvakken, dat haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen tot nul is teruggebracht. Echter:

    • a. Elke Partij mag deze gebruikslimiet overschrijden met ten hoogste 0,5% van de in het eerste lid van dit artikel bedoelde som in elk tijdvak van twaalf maanden dat eindigt voor 1 januari 2030, mits dit gebruik beperkt blijft tot het onderhoud van op 1 januari 2020 bestaande koel- en luchtbehandelingsapparatuur;

    • b. Elke Partij mag deze productielimiet overschrijden met ten hoogste 0,5% van het in het tweede lid van dit artikel bedoelde gemiddelde in elk tijdvak van twaalf maanden dat eindigt voor 1 januari 2030, mits deze productie beperkt blijft tot het onderhoud van op 1 januari 2020 bestaande koel- en luchtbehandelingsapparatuur.”

Artikel 5: Bijzondere positie van ontwikkelingslanden

• 3. De huidige onderdelen a en b van lid 8ter van artikel 5 worden vervangen door de volgende onderdelen, die onderdelen a, b, c, d en e worden:

  • „a. Elke Partij die onder de werking van het eerste lid van dit artikel valt, verzekert dat gedurende het tijdvak van twaalf maanden dat begint op 1 januari 2013 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan het gemiddelde van haar berekend gebruik in 2009 en 2010. Elke Partij die onder de werking van het eerste lid van dit artikel valt, verzekert dat gedurende het tijdvak van twaalf maanden dat begint op 1 januari 2013 en in elk tijdvak van twaalf maanden daarna haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan het gemiddelde van haar berekende productie in 2009 en 2010;

  • b. Elke Partij die onder de werking van het eerste lid van dit artikel valt, verzekert dat gedurende het tijdvak van twaalf maanden dat begint op 1 januari 2015 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan negentig procent van het gemiddelde van haar berekend gebruik in 2009 en 2010. Elke Partij die een of meer van deze stoffen produceert, verzekert, voor dezelfde tijdvakken, dat haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan negentig procent van het gemiddelde van haar berekende productie in 2009 en 2010;

  • c. Elke Partij die onder de werking van het eerste lid van dit artikel valt, verzekert dat gedurende het tijdvak van twaalf maanden dat begint op 1 januari 2020 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan vijfenzestig procent van het gemiddelde van haar berekend gebruik in 2009 en 2010. Elke Partij die een of meer van deze stoffen produceert, verzekert, voor dezelfde tijdvakken, dat haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan vijfenzestig procent van het gemiddelde van haar berekende productie in 2009 en 2010;

  • d. Elke Partij die onder de werking van het eerste lid van dit artikel valt, verzekert dat gedurende het tijdvak van twaalf maanden dat begint op 1 januari 2025 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan tweeëndertig en een half procent van het gemiddelde van haar berekend gebruik in 2009 en 2010. Elke Partij die een of meer van deze stoffen produceert, verzekert, voor dezelfde tijdvakken, dat haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen per jaar niet meer bedraagt dan tweeëndertig en een half procent van het gemiddelde van haar berekende productie in 2009 en 2010;

  • e. Elke Partij die onder de werking van het eerste lid van dit artikel valt, verzekert dat gedurende het tijdvak dat begint op 1 januari 2030 en in elk tijdvak van twaalf maanden daarna haar berekend gebruik van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen tot nul is teruggebracht. Elke Partij die een of meer van deze stoffen produceert, verzekert, voor dezelfde tijdvakken, dat haar berekende productie van de in Groep I van Bijlage C genoemde aan uitworpbeheersing onderworpen stoffen tot nul is teruggebracht. Echter:

    • i. Elke Partij mag deze gebruikslimiet in elk tijdvak van twaalf maanden overschrijden zolang de som van haar berekend gebruik over het tijdvak van tien jaar dat begint op 1 januari 2030 en eindigt op 1 januari 2040, gedeeld door tien, niet meer bedraagt dan twee en een half procent van het gemiddelde van haar berekend gebruik in 2009 en 2010 en mits dit gebruik beperkt blijft tot het onderhoud van op 1 januari 2030 bestaande koel- en luchtbehandelingsapparatuur;

    • ii. Elke Partij mag deze productielimiet in elk tijdvak van twaalf maanden overschrijden zolang de som van haar berekende productie over het tijdvak van tien jaar dat begint op 1 januari 2030 en eindigt op 1 januari 2040, gedeeld door tien, niet meer bedraagt dan twee en een half procent van het gemiddelde van haar berekende productie in 2009 en 2010 en mits deze productie beperkt blijft tot het onderhoud van op 1 januari 2030 bestaande koel- en luchtbehandelingsapparatuur.”

Argentinië, 18 september 1990

The Argentine Republic rejects the ratification of the above-mentioned Convention by the Government of the United Kingdom of Great Britain and Northern Ireland with respect to the Malvinas, South Georgia and South Sandwich Islands and reaffirms its sovereignty over those Islands, which form a part of its national territory.

The United Nations General Assembly has adopted resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12 and 39/6 in which it recognizes the existence of a sovereignty dispute concerning the question of the Malvinas and urges the Argentine Republic and the United Kingdom of Great Britain and Northern Ireland to resume negotiations in order to find as soon as possible a peaceful and definitive solution to the dispute and to their remaining differences relating to the question, through the good offices of the Secretary-General, who is to report to the General Assembly on the progress made. The United Nations General Assembly also adopted resolution 40/21 and 41/40, which again urge the two parties to resume the negotiations.

The Argentine Republic also rejects the ratification of the above-mentioned Convention by the Government of the United Kingdom of Great Britain and Northern Ireland with respect to what that country calls “British Antarctic Territory”.

At the same time, it reaffirms its rights of sovereignty over the Argentine Antarctic Sector located between longitudes 25o and 74o W and latitude 60o S and the South Pole, including its maritime spaces.

It is appropriate to recall, in this connection, the provisions concerning rights of or claims to territorial sovereignty in Antarctica contained in article IV of the Antarctic Treaty.

The accession by the State of Bahrain to the said Convention shall in no way constitute recognition of Israel or be a cause for the establishment of any relations of any kind therewith.

In the view of the Government of the State of Israel such declaration, which is explicitly of a political character, is incompatible with the purposes and objectives of the Convention and Protocol and cannot in any way affect whatever obligations are binding upon Bahrain under general international law or under particular conventions.

The Government of the State of Israel will, in so far as concerns the substance of the matter, adopt towards Bahrain an attitude of complete reciprocity.

Chili, 26 maart 1990

[Chile] rejects the declaration made by the United Kingdom of Great Britain and Northern Ireland upon ratification, as it concerns the Chilean Antarctic Territory, including the corresponding maritime zones: [Chile] reaffirms once more its sovereignty over the said territory including its maritime areas, as defined by Supreme Decree No. 1747 of 6 November 1940.

In the light of article 2.8 of the Protocol, the Community wishes to state that its signature takes place on the assumption that all its member states will take the necessary steps to adhere to the Convention and to conclude the Protocol.

• 1. On behalf of the European Community, it is hereby declared that the said Community can accept arbitration as a means of dispute settlement within the terms of the Vienna Convention for the Protection of the Ozone Layer.

  It cannot accept submission of any dispute to the International Court of Justice.

• 2. According to the customary procedures within the European Community, the Community's financial participation in the Vienna Convention for the Protection of the Ozone Layer and in the Montreal Protocol on substances that deplete the Ozone Layer may not involve the Community in expenditure other than administrative costs which may not exceed 2.5 % of the total administrative costs.

  Declaration by the European Economic Community in conformity with Article 13 (3) of the Vienna Convention for the protection of the ozone layer concerning the extent of its competence with respect to the matters covered by the Convention and by the Montreal Protocol on substances that deplete the ozone layer: In accordance with the relevant Articles of the EEC Treaty, the Community has competence to take action relating to the preservation, protection and improvement of the quality of the environment.

  The Community has exercised its competence in the area covered by the Vienna Convention and the Montreal Protocol in adopting Council Decision 80/372/EEC of 26 March 1980 concerning chlorofluorocarbons in the environment (1), Council Decision 82/795/EEC of 15 November 1982 on the consolidation of precautionary measures concerning chlorofluorocarbons in the environment (2) and Council Regulation (EEC) N 3322/88 of 14 October 1988 on certain chlorofluorocarbons and halons which deplete the ozone layer. The Community may well exercise its competence in the future by adopting further legislation in this area.

  In the field of research in the environment, as referred to by the Convention, the Community has a certain competence by virtue of Council Decision 86/234/EEC of 10 June 1986 adopting multiannual R& D programmes in the field of the environment (1986 to 1990).

The Republic of Mauritius rejects the ratification of [the Protocol] effected by the Government of the United Kingdom of Great Britain and Northern Ireland on 16 December 1988 in respect of the British Indian Ocean Territory namely Chagos Archipelago and reaffirms its sovereignty over the Chagos Archipelago, which form an integral part of its national territory.

The Government of the People’s Republic of China would like to restate that the provision of article 5 of the Montreal Protocol on Substances that Deplete the Ozone Layer of 16 September 1987 and the provision of paragraph 1, article 5 of the Amendment to the Montreal Protocol on Substances that Deplete the Ozone Layer adopted in London on 29 June 1990 will not apply to the Macao Special Administrative Region of the People’s Republic of China.

In overeenstemming met artikel 2, negende lid, letter d, eerste zin van het Protocol heeft de Secretaris-Generaal van de Verenigde Naties op 14 november 2007 de aanpassingen van 21 september 2007 medegedeeld aan de Partijen bij het Protocol.

Ingevolge artikel 2, negende lid, letter d, tweede zin van het Protocol zijn deze aanpassingen op 14 mei 2008 in werking getreden.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat de aanpassingen van het Protocol zullen zijn bekendgemaakt in Nederland, de Nederlandse Antillen en Aruba op de dag na de datum van uitgifte van dit Tractatenblad.
